Couple Sues Boston Scientific Over Vaginal Mesh Complications

transvaginal meshDebra Glasman and her husband Michael J. Glasman have joined the multidistrict litigation against Boston Scientific over complications allegedly caused by the company’s transvaginal mesh products. 

Multidistrict litigation or MDL is a type of mass lawsuit similar to a class action lawsuit. In both class action lawsuits and MDL, a number of plaintiffs allege that they have suffered from similar injuries caused by the same defendant. In both types of legal actions, consolidating the lawsuits saves parties time and money, and avoids duplicating efforts in separate, similar lawsuits. The main difference between class action lawsuits and MDL is that in a class action suit, all of the plaintiffs are represented by a single lawyer or team of lawyers while in MDL, each individual party keeps their own lawyer or legal team.

In March 2007, Debra Glasman had a transvaginal mesh implant surgically grafted into her body in a hospital in Miami. Vaginal mesh is a variation on surgical mesh. Surgical mesh was first invented in the 1970s as a tool for surgeons to provide support to patients’ internal organs when their typical support structures, e.g. muscles, are damaged. Initially, surgeons cut surgical mesh into special shapes for pelvic surgeries. Surgical supply companies capitalized on this niche, creating pre-cut mesh specifically designed for pelvic surgeries. Since it was based on existing medical technology, pelvic mesh was able to legally bypass many steps of clinical testing.

Many patients who received pelvic mesh implants went on to suffer from serious, painful complications. Some patients experienced erosion, a condition wherein the mesh cuts its way through the very tissues it is designed to protect. In other patients, the body grows around the mesh, causing pain. This condition, called embedment, often requires surgery to remove the offending mesh. In some cases, surgeons cannot successfully remove all of the mesh, leaving the patient with permanent pain and vulnerability to further complications. 

The Boston Scientific vaginal Mesh MDL is formally titled In Re: Boston Scientific Corporation Pelvic Repair System Products Liability Litigation, Case No. 2:13-cv-22202, MDL No. 2326, in the U.S. District Court for the Southern District of West Virginia.
