Couple Sues Bayer Over Wife’s Yasmin/Yaz Blood Clot Injuries
By Kimberly Mirando
A New York woman and her husband have filed a Yaz/Yasmin blood clot lawsuit against Bayer alleging she developed a dangerous blood clot from taking Yaz/Yasmin birth control that caused her suffer deep vein thrombosis and a pulmonary embolism. Her lawsuit joins nearly 11,900 Yasmin/Yaz lawsuits pending in the United States filed by women and their family members alleging serious Yaz blood clot injuries — some fatal — caused by the use of Yasmin and Yaz. Lawyers suing the drug maker cited FDA reports of at least 50 deaths tied to the pills from 2004 to 2008.
Plaintiff Angela Wright alleges in the Yasmin blood clot lawsuit that she took Yasmin/Yaz from January 2010 to June 2011 before developing a dangerous blood clot that caused her to suffer deep vein thrombosis (DVT) and a pulmonary embolism. These are the same Yasmin/Yaz side effects listed in thousands of Yasmin/Yaz lawsuits seeking compensation for victims’ medical expenses, pain and suffering. Like Wright, Plaintiffs in the Yasmin/Yaz lawsuits want Bayer held liable for failing to adequately warn the public about the serious risks of developing a dangerous blood clot from taking combined estrogen and synthetic progestin (drospirenone) birth control products such as Yasmin and Yaz. Many of these Plaintiffs are also seeking compensation for their spouses for “loss of consortium,” claiming their spouses lost the company and “society” of their wives as a result of the Yaz injuries they suffered. Spouses can win hundreds of thousands of dollars under “loss of consortium” claims.
Bayer has already agreed to pay $142 million in Yasmin/Yaz lawsuit settlements, offering Plaintiffs an average payout of about $218,000 each. All of the Yasmin/Yaz settlements were for cases in the current Yasmin/Yaz lawsuit MDL pending in the U.S. District Court for Southern Illinois, entitled Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Products Liability Litigation. The Yaz MDL is often a good choice for Plaintiffs hoping to sue Bayer because it allows them to retain their own Yaz attorney and receive an individual award if the case is won or settled. A Yasmin/Yaz class action lawsuit, however, could result in a lower award payment because it is split up amongst hundreds, or thousands, of Class Members. The individual award a Plaintiff would receive in a Yaz lawsuit MDL settlement would be based on the severity of that individual’s injury, which will be determined by the Yasmin/Yaz law firms litigating the MDL.
If you suffered a Yasmin/Yaz side effect such as blood clot, deep vein thrombosis (DVT), pulmonary embolism (PE), stroke or heart attack, a Yasmin/Yaz injury compensation specialist can provide a free consultation about your legal rights. Without the help of a skilled Yasmin/Yaz attorney, your chances of securing a Yasmin/Yaz blood clot settlement from a corporate giant like Bayer is very slim.
