Couple Files Fosamax Femur Fracture Lawsuit

Fosamax femur fracture lawsuitThe latest in Fosamax lawsuit news indicates that another Fosamax femur fracture lawsuit has been filed. On October 31, 2012, a Fosamax lawsuit was filed by an Illinois couple who claim the female plaintiff experienced a femur fracture after using Fosamax to treat her osteoporosis. The husband and wife filed the Fosamax lawsuit in the New Jersey District Court and it is now referred to as case no. 3:2012cv06770. The defendant named in the Fosamax lawsuit is Merck, the manufacturer of Fosamax.

The Details of This Fosamax Femur Fracture Lawsuit

The Fosamax lawsuit claims that the plaintiff was given a prescription for Fosamax over 10 years ago.  She received a prescription for Fosamax in 2001 and took it until 2012. From there it is reported that the Illinois woman experienced weakened and brittle bones and subsequently experienced “a low energy femoral fracture” due to the long-term use of the medication.  It is unsure at this time whether or not this Fosamax lawsuit will join a Fosamax class action lawsuit or a multidistrict litigation lawsuit; however, that is definitely an option.

The History of Fosamax and Its Side Effects

Fosamax belongs to a certain medication class referred to as bisphosphonates. It received its approval from the United States Food and Drug Administration nearly two decades ago in 1995. It was developed and approved in the treatment of post-menopausal osteoporosis as well as Paget’s disease of bone.

On October 17th, 2012 a new study was published by The Journal of Clinical Endocrinology & Metabolism, which concluded that an atypical femur fractures that occurred in patients that took medications like Fosamax experience a number of side effects including the following:

  • Delayed healing
  • Persisting side effect risk of a contralateral and/or other fractures
  • Prodromal pain


Thousands of Fosamax Lawsuits Now Pending

It has been reported that there are now over 2,200 Fosamax lawsuits that are still pending. The plaintiffs all claim that they have experienced femur fractures, as the Fosamax lawsuit discussed above, as well as other injuries, like Fosamax jaw problems.

There has been a multidistrict litigation (MDL) established for the Fosamax lawsuits. It is currently being held in the United States District Court for the Southern District of New York. It is now referred to as In Re: Fosamax Products Liability Litigation No. 06 MD 1789. It is being presided over by the Honorable Judge John F. Keenan.
