Calif. Couple Sues Ethicon Over Defective Vaginal Mesh Implant

By Andrea Gressman

Gynecare vaginal mesh injuryA California couple has joined the growing number of men and women suing Johnson & Johnson subsidiaries Ethicon and Gynecare Inc. for selling defective vaginal mesh implants that caused debilitating side effects for women.

All of the vaginal mesh implant lawsuits have similar complaints against the manufacturers of these products. They allege manufactures did not properly warn patients of the potential side effect risks these devices carry. This particular vaginal mesh lawsuit alleges that due to the negligent actions of the manufacturers, the plaintiff has suffered severe physical pain and emotional distress. She is seeking compensatory as well as punitive damages while the husband is seeking loss of marital support, loss of consortium, and other damages.

Ethicon Falsely Advertised Side Effect Risk of Gynecare Vaginal Mesh

The female plaintiff in this lawsuit received a Gynecare vaginal mesh implant on February 25, 2009 to treat a condition called cystocele. Cystocele occurs when the bladder is unable to stay in its properly working position because of weakened vaginal walls. The vaginal mesh implant the plaintiff received was supposed to treat her condition and provide strength in the vaginal walls. What she got instead were some of the following side effects:

  • Chronic pain
  • Continual bladder infections
  • Tissue damage

The plaintiff has had to endure numerous surgeries in an effort to treat these severe side effects, according to the lawsuit. Her lawyer alleges the manufacturer falsely advertised their product as a safe and effective treatment option for those suffering from stress urinary incontinence and pelvic organ prolapse. The plaintiff charges that the manufacturer was aware of the side effect risks due to FDA complaints and a number of studies that have been completed over the years yet did not provide proper warning to potential patients, the medical community, or the general public.
