Boner Bears class action lawsuit overview:
- Who: Plaintiff Brian Keegan has filed a class action lawsuit against the makers of Boner Bears herbal erectile dysfunction remedy products.
- Why: The defendants allegedly fail to disclose that Boner Bears “natural” products include the prescription drug tadalafil.
- Where: The Boner Bears class action lawsuit was filed in Florida federal court.
The Boner Bears herbal remedy for erectile dysfunction is not “natural” as advertised because the company fails to disclose that it actually contains a pharmaceutical ingredient, according to a class action lawsuit filed March 17 in Florida federal court.
Plaintiff Brian Keegan says the Boner Bears product is touted as “a proprietary blend of organic ingredients designed to increase performance in the sack.”
However, defendants Daniel P. Minihan, Perk Industries Inc. and Innovative Health Labs Inc. allegedly fail to disclose that the Boner Bears products are “covertly adulterated” with tadalafil, a pharmaceutical ingredient included in the pharmaceutical Cialis.
Drugs like Cialis are in a class of pharmaceuticals called phosphodiesterase inhibitors, which treat erectile dysfunction by blocking an enzyme in the blood vessels, allowing for increased blood flow to the penis, Keegan says.
Tadalafil is currently available in the United States by prescription only, the Boner Bears class action lawsuit explains.
Keegan alleges the defendants deceptively market the Boner Bears product as natural without disclosing its pharmaceutical ingredients.
The Boner Bears class action lawsuit says the defendants “are in reality, covert, unauthorized and unlicensed drug dealers who violate federal criminal statutes by introducing misbranded drugs into interstate commerce.”
Defendants conceal drug in Boner Bears natural remedy because it is illegal to sell without prescription, plaintiff says
Analysis of the Boner Bears product reportedly found that each dose contains 17.3mg of tadalafil even though this prescription-only drug is not disclosed on the product label.
“Defendants conceal the substantial presence of Tadalafil in Boner Bears because Tadalafil may not be sold and/or lawfully obtained by a U.S. consumer without medical supervision and a prescription,” the Boner Bears natural class action lawsuit asserts.
To make matters worse, Keegan says the 17.3mg dose is nearly twice the recommended 10 mg starting dose of tadalafil.
Keegan says he has a medical condition that prohibits him from safely ingesting tadalafil. He purchased Boner Bears in reliance on the claim that it was made with only natural ingredients, according to the Boner Bears class action lawsuit.
However, after ingesting the product, he says he experienced blurred vision, dizziness, and headache.
The Boner Bears natural class action lawsuit asserts a claim for common law fraud.
Volt Candy recently issued a recall of some of its PrimeZen Black 6000 erectile dysfunction pills over concerns that they are contaminated with drugs that can potentially cause a life-threatening drop in blood pressure.
