$1.5M Fosamax Lawsuit Settlement Awarded to Jaw Decay Victim

A plaintiff in a Fosamax lawsuit recently reached a settlement with Merck, the manufacturer of the bone drug. The woman, Shirley Boles, reportedly experienced jaw damage as a result of taking Fosamax.
Ms. Boles alleged in the Fosamax lawsuit that the osteoporosis medication caused her to experience osteonecrosis of the jaw. The very first Fosamax lawsuit she filed actually ended up as a mistrial. However, another trial in June of 2012 resulted in the jury awarding Ms. Boles $8 million in compensation. However, the judge later found that award to be excessive and subsequently reduced the award by $1.5 million. Ms. Boles did not accept the reduced Fosamax lawsuit settlement and instead sought a 3rd trial. That was set to begin in September of 2012. But prior to the trial taking place the plaintiff and Merck were able to reach a settlement in the Fosamax lawsuit. It has been reported that this is a confidential damages agreement and therefore, the amount of compensation has not been made public.
Fosamax Lawsuits Claiming Femur Fractures as Side Effects
Fosamax jaw decay is not the only side effect targeted in Fosamax lawsuits. Hundreds of Fosamax lawsuits have been filed by users who suffered atypical femur fractures. The majority of these Fosamax injury lawsuits have been consolidated in a New Jersey MDL known as In re: Fosamax Litigation (No. 282 N.J. Super. The atypical femur fractures are evidently being experienced by Fosamax users quite frequently.
