A woman from New York has recently filed a Target personal injury lawsuit, after sustaining a fall at one of the retail company’s locations. The Target personal injury lawsuit alleges the store location was not sufficiently cleaned or suitable to be considered a reasonably safe environment, which allegedly resulted in her injury.
According to the Target personal injury lawsuit, plaintiff Maria S. had sustained serious injuries at a Target shopping center on Dec. 23, 2017.
The interior of the store was reportedly slippery due to garbage, debris, boxes, papers, and other materials that were not supposed to cover the floor. This caused the surface to be greasy and dusty, she claims, which ultimately caused Maria to slip and sustain serious injury.
The injuries named in the Target personal injury lawsuit includes serious physical harm that has impaired the quality of Maria’s life.
Maria opted to file legal action against the company, after discovering the quality of the store location did not meet reasonable safety standards.
Overview of Personal Injury Allegations
This Target personal injury lawsuit is a recent example of consumers seeking justice for preventable injuries, which were allegedly caused by a company’s negligence. Personal injury lawsuits can be filed for different kinds of negligence including:
- Car or other transportation accidents
- Slip or Fall Accidents
- Dog Bites or other Animal Attack Incidents
- Dangerous Environment on the Premises
- Selling Defective Products
- Catastrophic Injury
- Medical Malpractice
- Workplace Injuries
Personal injury lawsuits typically focus on physical injuries claimants sustain on the defendant’s premises, but can sometimes involve property damage as well as emotional or mental trauma.
Companies facing personal injury lawsuits are generally expected to have taken the same precautions, as expected of a reasonable person. Claimants who choose to file personal injury claims typically have to prove the following to be awarded damages:
- The company had a duty of care towards the claimant
- The company breached that duty or failed to meet the standard
- The company’s breach caused the claimant’s injuries
- The company’s negligence directly contributed towards the claimant’s injuries
It is important to note that every case is different, and may depend on the nature of the lawsuit as well as the circumstances surrounding it. Additionally not all accidents are caused by negligence, but are generally determined by whether or not the incident could have been prevented by reasonable care.
Another important note is that not all personal injury cases proceed to trial, with many of them being settled in mediation or arbitration. The settlements paid to these claims will help resolve any incurring medical expenses related to any injuries caused by the alleged accident, along with other losses liked missed work or loss of income.
Maria argues the Target Corporation was under reasonable expectation for maintaining each of its store locations, and ensuring that they are safe for their customers and employees. Furthermore, the company should have ensured that all unwanted or unnecessary debris was removed from the shopping floor, which could have prevented Maria’s injuries.
This Target Personal Injury Lawsuit is Case No. 1:18-cv-04373-JPO, in the Supreme Court of the State of New York, New York County.
