PHH agreed to a $2.77 million class action lawsuit settlement to resolve claims that it charged illegal service fees on internet mortgage payments.

The settlement benefits a national Fair Debt Collection Practices Act (FDCPA) class of residential mortgage borrowers whose loans were serviced but not owned by Ocwen or PHH after the servicers acquired servicing rights when the loans were 30 days or more delinquent and who paid a convenience fee to Ocwen between March 25, 2019, and Aug. 17, 2022.

The settlement also benefits a statewide class of Florida residential mortgage loan borrowers who paid a convenience fee to Ocwen or PHH between March 25, 2016, and Aug. 17, 2022.

Plaintiffs in the class action lawsuit accused PHH Mortgage of charging illegal convenience fees when making loan payments on the internet or through its telephone payment system. These fees allegedly violated the FDCPA and the Florida Consumer Collection Practices Act.

PHH Mortgage is a loan servicing company owned by Ocwen Financial. 

PHH hasn’t admitted any wrongdoing but agreed to a $2.77 million class action settlement to resolve these allegations. The company agreed to a similar settlement in 2020.

Under the terms of the settlement, class members can receive a proportional share of the net settlement fund based on the amount they paid PHH in convenience fees. FDCPA class members will receive a share of $1.23 million and Florida class members will receive a share of $1.54 million. Class members who are eligible for both classes will receive proportional shares of both settlement funds.

The deadline for exclusion and objection is April 26, 2023.

The final approval hearing for the PHH settlement is scheduled for May 31, 2023.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive settlement benefits.

    Ocwen, now PHH has made numerous mistakes on my FHA loan for years; the point of contact will never ever call back; PHH has taken all the funds they can get from me on loan modifications that were never fully approved, raised the bar each month to now show a huge outstanding balance, a rep from FHA justifies the entire situation; now they hired Western Progressive with a current foreclosure; they post my home on Auction.com; strangers are driving by, coming up to the door, calling and texting like I’m a criminal

    I have also asked for modifications and did deferments and sent in documents and paid balances that were needed to move forward in completing my requests. Money taken but no justification.

    Ocwen foreclosure on me in 2016 then called me in 2017 and told me rhat they wrongful foreclosure on me and never returned my property are nothing just left me homeless from my property of 48 years I never heard nothing from them since and my State of Kentucky never helped me this is so unfair and unconstitutional

    Started with Ocwen in 2007 for $205,000 – refinance with money out. Then changed to PHH mortgage services, not sure the exact year. Payments have increased every year due to insurance and taxes. Also included in these increases are Agency Fees. Call and ask what the agency fees are and NO one has a clue. The agency fees this year are $637.73 and NO one can explain. So after 3 off schedule escrow notices this year and each notice demanded more money or the payment would increase by October – I get my new statement for October with a new monthly payment increasing by $15.79 each month. Those 3 off schedule escrow notices totaled $494.16. The $15.79 monthly increase totals $189.48 for the year and they have already collected the $494.16. Cheats, liars and thieves would do this.

    I have a legal issue with Ocwen and PHH. I stopped paying them Because Ive been paying them for 29 years and the payments has been misapplied. in the year 2000, I started the promissory note at 100,000.00. in 2014 the balance was 138,000.00. Ocwen breached the contract by not applying my payments correctly. now my mortgage is under a balloon payment and is set to mature in 2050. in 2050 i would owe PHH 24,000.00 in full.

    Owned my home for 16 years purchased for 149,700 every year escrow short, each year mortgage climbed. Sold my home on 2020 for 250,000 PHH send an 8k check how is this possible. My children were traumatized they were ripped from childhood home due to their errors , multiple times have tried to rectify also paid a 30k lump sum on home 2014 yet payoff 187,000 how the hell? And sent four differnt payoff numbers all dated the same
