Eskaton Properties and California Healthcare Consultants agreed to pay a $5.5 million wage settlement to resolve a class action lawsuit claiming they failed to pay their California employees for all hours worked.

The settlement benefits individuals who worked for Eskaton Properties Inc. and/or California Healthcare Consultants Inc. in California between June 2, 2017, and June 11, 2022.

Plaintiffs in the class action lawsuit say Eskaton Properties and California Healthcare Consultants failed to compensate workers for all regular and overtime hours worked, provide meal and rest breaks, reimburse employees for business expenses, compensate workers for mandatory tests and more. These failures allegedly violated California labor laws.

Eskaton Properties is a senior-living community in Northern California. 

The defendants haven’t admitted any wrongdoing but agreed to a $5.5 million class action settlement to resolve these allegations.

Under the terms of the wage settlement, class members can receive a proportional share of the net settlement fund based on the number of workweeks they worked during the class period. Employees who worked for the entire class period will receive a larger share than those who worked only a small number of workweeks. Exact payments will vary.

Payments from the wage settlement may have tax consequences. One-fourth of each settlement fund will be considered wages for tax purposes, while the other three-fourths will be considered penalties and interest. Class members may wish to consult with their tax advisors regarding these payments.

The deadline for exclusion and objection is May 2, 2023.

The final approval hearing for the settlement is scheduled for July 28, 2023.

No claim form is required to benefit from the wage settlement. Class members who do not exclude themselves will automatically receive settlement benefits.
