Mortgage lender Citywide Home Loans agreed to a $1,225,000 class action lawsuit settlement to resolve claims surrounding a 2020 data breach.
The settlement benefits those who were employed by Citywide Home Loans LLC and who were sent a summary notice of the data breach incident between February and April 2021.
According to the lawsuit, Citywide Home Loans was negligent in failing to protect its internal systems, leading to a data breach Nov. 18, 2020. During the breach, an unauthorized person allegedly gained access to the Citywide systems and deployed ransomware, resulting in the encryption of certain systems and the alleged compromise of the personally identifiable information of current and former employees of Citywide Home Loans.Â
The data that was compromised allegedly included names, addresses, phone numbers, dates of birth, Social Security numbers, passport numbers, driver’s license numbers, credit card information, bank account information and/or medical or insurance information.Â
Citywide denies liability for the incident but is settling the lawsuit to end the claims.Â
Citywide Home Loans is a Utah-based mortgage lending company founded in 1998. Citywide has more than 800 employees and operates in 35 states.
Under the terms of the settlement, class members can submit a claim form to receive two years of Kroll credit monitoring and identity theft protection services.
Class members who experienced economic losses or lost time related to the data breach may also submit a claim form, along with documentation proving the losses, in return for a cash reimbursement.Â
The company will pay valid claims for economic losses due to the data breach up to $5,000 and lost time up to $200.Â
If all valid claims exceed $1,225,000, payments will be reduced pro rata, the settlement agreement states.
The deadline for exclusion and objection is July 10, 2023.
The final approval hearing for the Citywide settlement is scheduled for Aug. 25, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Aug. 8, 2023.
