The Washington Department of Licensing (DOL) agreed to a $3.6 million class action lawsuit settlement to resolve claims that it failed to prevent a 2022 data breach.

The settlement benefits individuals whose personal information was compromised in the 2022 data breach disclosed by the Washington State Department of Licensing in February 2022.

Plaintiffs in the data breach class action lawsuit claim that the Washington Department of Licensing could have prevented the security incident through reasonable cybersecurity measures but failed to do so out of negligence. The 2022 data breach compromised sensitive information such as licensing information, Social Security numbers, birth dates and ID numbers. 

The Washington Department of Licensing is responsible for issuing driver’s licenses, vehicle registrations and more.

The Washington DOL hasn’t admitted any wrongdoing but agreed to a $3.6 million settlement to resolve the data breach class action lawsuit.

Under the terms of the settlement, class members can receive up to $7,500 for documented breach-related expenses such as bank costs, credit fees, fraudulent charges, identity theft costs and up to four hours of lost time at a rate of $35 per hour. 

If additional funds remain in the settlement after reimbursement, class members may receive an additional pro rata payment of up to $300 from the residual funds.

Class members can also receive two years of free identity theft protection and credit monitoring. This service includes dark web monitoring, identity recovery services and $1 million in identity theft insurance. 

The deadline for exclusion and objection is Aug. 9, 2023.

The final approval hearing for the Washington Department of Licensing data breach settlement is scheduled for Sept. 15, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Oct. 9, 2023.

      I believe that the massive fraudlent unemployment claims in 2020 stem from this very same cyber attack. The DOL is tied to fingerprint and background checks. Hundreds plus of washington state workers whose ide tity was stolen and then used to make fraudulent unemployment claims, are fingerprinted and have their background check completed from directions via the DOL web site . The WSP and FBI then preform the actual fingerprint and if warranted background checks. According to Washington unemployment, the ” massive leak of individual personal info happened at some other agencies cyber attack. The DOL cyber attack happened in January 2020, this is approximately 4 months before the WA unemployment fraudulent claims using the teachers and firefighters identity happened. I want be added to this or a new investigation ve opened for what I’ve just talked about. I spent many many hours in an attempt to clearing my identity. Watching credit reports,trying to file unemployment myself, dealing with rejection, freezing( which is easy) my credit report and then trying to unfreeze it( which is not so easy and time consumming). Countless hours of .y time and health spent on something because the state did not protect me. They can see clearly that I was working when the fraudulent claim was made using my identity. How could anyone of those workers approve an unemployment claim using my identity. Pandemic is no excuse. Teachers were working, firefighters were working. Washington State had lazy workers and lazy system and I had to pay for it with my personal mental and emotional health.
