Marymount Manhattan College agreed to a $1.3 million class action lawsuit settlement to resolve claims it failed to prevent a 2021 data breach that compromised sensitive student, parent and employee information. 

The settlement benefits individuals who received a notice letter from Marymount Manhattan College indicating their personal information was compromised in a November 2021 data breach. 

According to the class action lawsuit, Marymount Manhattan College failed to implement reasonable cybersecurity measures that would have prevented a November 2021 data breach. As a result of this alleged negligence, thousands of individuals suffered from compromised identifying information, such as Society Security numbers, the plaintiffs contend. 

Marymount Manhattan College is a small college in New York City. 

Marymount hasn’t admitted any wrongdoing but agreed to a $1.3 million settlement to resolve the data breach class action lawsuit.

Under the terms of the Marymount Manhattan College settlement, class members can receive a cash payment of up to $750 for documented out-of-pocket expenses related to the data breach and related lost time. Covered expenses include bank fees, communication charges, credit costs and other miscellaneous expenses. Class members can claim up to five hours of lost time, compensated at a rate of $20 hour, for a maximum lost-time payment of $100, subject to the $750 limit.

Class members who experienced extraordinary data breach losses resulting from fraud or identity theft can receive a high payment of up to $7,500. To claim these losses, class members must have exhausted all benefits available under credit monitoring services, identity theft insurance, card fraud resources and other services. 

In lieu of ordinary and extraordinary expense reimbursement, class members can choose an alternate cash payment of $150. 

All class members, regardless of which cash payment option they choose, can receive one year of free credit monitoring and identity theft protection services. This benefit includes three-bureau credit monitoring, up to $1 million in identity theft insurance coverage and other services.

The deadline for exclusion and objection is Aug. 15, 2023.

The final approval hearing for the Marymount Manhattan College settlement is scheduled for Sept. 6, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Aug. 15, 2023.
