UKG agreed to a $6 million class action lawsuit settlement to resolve claims it failed to protect consumer information in a 2021 data breach that attacked its Kronos private cloud.
The settlement benefits current and former employees or contractors of UKG customers whose data was stored in the Kronos private cloud during the December 2021 data breach.Â
The settlement also benefits an exfiltration subclass of individuals who received a data breach notice informing them their information was exfiltrated during the December 2021 data breach.
In addition, the settlement benefits a California subclass of current and former employees or contractors of UKG customers whose data was stored in the Kronos private cloud during the December 2021 data breach and who lived in California at the time of the data breach.
According to the class action lawsuit, UKG failed to implement reasonable cybersecurity measures that would have prevented a ransomware attack on its Kronos private cloud in December 2021. The data breach reportedly compromised the information of millions of employees and made it impossible for them to be paid their full paychecks.
Kronos is a time-keeping and human resources company now known as UKG. The company provides services and software to millions of employers around the globe.
UKG hasn’t admitted any wrongdoing but agreed to a $6 million settlement to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members can receive up to $1,000 for ordinary losses related to the data breach, including communication charges, credit monitoring fees, bank fees and up to four hours of lost time at a rate of $25 per hour. Class members who experienced extraordinary data breach losses as a result of fraud or identity theft can recover additional payments of $7,500 for these expenses.
UKG agreed to enhance its online privacy protection measures as part of the data breach settlement. The company is expected to spend over $1.5 million on these measures.Â
The deadline for exclusion and objection is Sept. 18, 2023.
The final approval hearing for the UKG Kronos class action lawsuit settlement is scheduled for Nov. 17, 2023.
To receive settlement benefits, class members must submit a valid claim form Oct. 3, 2023.
Who’s Eligible
Current and former employees or contractors of UKG customers whose data was stored in the Kronos private cloud during the December 2021 data breach.Â
Exfiltration subclass: Individuals who received a data breach notice informing them their information was exfiltrated during the December 2021 data breach.
California subclass: Current and former employees or contractors of UKG customers whose data was stored in the Kronos private cloud during the December 2021 data breach and who lived in California at the time of the data breach.
