Bobak Sausage Co. agreed to a nearly $238,000 settlement to resolve claims it violated the Illinois Biometric Information Privacy Act (BIPA) by requiring employee finger scans for timekeeping.

The settlement benefits approximately 297 individuals employed by Bobak Sausage Co. in Illinois who logged onto, interfaced with or used any software, systems or devices that used their hand or any biometric identifier of any type at the company between May 5, 2015, and Sept. 1, 2020.

According to the class action lawsuit, Bobak Sausage Co. violated Illinois privacy law by failing to provide disclosures and get consent before requiring workers to use their fingerprints to clock in and out of work. 

Bobak Sausage is a Chicago-based sausages and deli meats company founded in 1967, with products shipped across Illinois and Indiana.

The company hasn’t admitted any wrongdoing but agreed to a $237,500 class action settlement to resolve the BIPA allegations. 

Under the terms of the Bobak Sausage Co. employee BIPA settlement, class members can receive an equal share of the net settlement fund. Class counsel estimates each class member will receive $419. However, exact payments may be higher or lower based on the number of participating class members.

The deadline for exclusion and objection is July 17, 2023.

The final approval hearing for the settlement is scheduled for August 31, 2023.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.
