Wenzak Heartland agreed to pay over $1.9 million as part of a settlement to resolve claims it violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting employee biometrics without their written consent.Â
The settlement benefits current and former Wenzak workers who used a finger or hand scanning device in Illinois within the last five years.Â
According to the class action lawsuit, Wenzak failed to provide the proper disclosures and obtain consent before collecting worker biometric information for timekeeping purposes. Plaintiffs in the case say this violated BIPA.
Wenzak is a Wendy’s franchise owner in Illinois.
Wenzak hasn’t admitted any wrongdoing but agreed to a $1.9 million settlement to resolve the BIPA class action lawsuit.
Under the terms of the settlement, class members can receive an equal share of the net settlement fund.Â
Exact payment amounts will vary depending on the number of valid claims submitted to the settlement. No payment estimates are available at this point.
The deadline for exclusion and objection is June 20, 2023.
The final approval hearing for the settlement is scheduled for July 17, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by June 20, 2023.
