Atlantic Recovery Solutions agreed to pay nearly $52,000 to resolve a class action lawsuit claiming that it violated California law by placing debt-collection calls and texts to consumers.
The settlement benefits California residents who received voicemail messages and/or text messages from Atlantic Recovery Solutions LLC in an attempt to collect a defaulted debt originally owed to Sallie Mae Bank since June 6, 2021.
According to the class action lawsuit, Atlantic Recovery Solutions violated California debt-collection laws by sending unlawful texts and voicemail messages in an attempt to collect on defaulted consumer debts. The debts were reportedly held by DNF Associates LLC but were originally owed to Sallie Mae, an education lender.
Atlantic Recovery Solutions is a debt-recovery agency that has reportedly cured over 33,840 delinquencies.
Atlantic Recovery Solutions hasn’t admitted any wrongdoing but agreed to a $51,975 settlement to resolve the spam text class action lawsuit.
Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of valid claims filed, though class members are to receive “no less than $175 each,” according to the settlement website.
Any remaining settlement funds after distribution will be donated to Alexander Community Law Center.
The deadline for exclusion and objection is Feb. 9, 2024.
The final approval hearing for the settlement is scheduled for March 14, 2024.
No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.
