Ima Pizza LLC, doing business as &Pizza, agreed to a $750,000 class action lawsuit settlement to resolve claims that it sent marketing text messages to consumers after they chose to opt out of these messages.
The settlement benefits consumers identified by Ima Pizza’s records who received text messages from &Pizza after they requested to no longer receive text messages.
Plaintiffs in the class action lawsuit claim that &Pizza continued to send them text messages even after they opted out of receiving marketing texts. These texts allegedly violated the Telephone Consumer Protection Act (TCPA).
&Pizza is a pizza chain operated by Ima Pizza with locations in Washington, D.C., Maryland, Virginia, Pennsylvania, New Jersey and New York.Â
&Pizza hasn’t admitted wrongdoing but agreed to a $750,000 settlement to resolve the TCPA class action lawsuit.
Under the terms of the settlement, class members can receive $372 per post-opt-out text they received from &Pizza, not including a text confirming the opt-out. This means claimants who received multiple post-opt-out text messages can receive multiple payments of $372. For example, a class member who received two post-opt-out text messages could receive $744.
If the number of claims filed would cause the total amount to be paid out to exceed the settlement funds, class members’ payment amounts could be reduced from $372.
The deadline for exclusion and objection is Feb. 16, 2024.
The final approval hearing for the settlement is scheduled for March 27, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by March 18, 2024.
