Amica has agreed to pay over $484,000 as part of a diminished value class action lawsuit settlement resolving claims it undervalued vehicles in auto insurance claims.
The settlement benefits Washington drivers insured by Amica who got into an accident after March 23, 2014, and meet the following criteria:
- The vehicle repair estimate totaled at least $1,000
- The vehicle was under 6 years old (five model years) and had less than 90,000 miles on the odometer when it got in an accident
- The vehicle suffered frame/structural damage, deformed sheet metal, and/or required body or paint repairs
Drivers are not eligible for the undervalued vehicles settlement if their vehicle was leased, if the vehicle was declared a total loss, or if the accident occurred before March 23, 2014 — even if all other criteria are met.
Plaintiffs in the Amica insurance class action lawsuit say their vehicles’ structural systems and bodies were damaged in accidents and could be repaired to their pre-accident conditions. As a result, these vehicles allegedly suffer from “diminished value.”
According to the plaintiffs, Amica should have compensated them for the “diminished value” sustained as a result of structural or body damage in their auto insurance claims. Because this loss of value was not reimbursed, Amica allegedly undervalued consumers’ vehicles and did not adequately compensate them after an accident.
Amica has not admitted any wrongdoing but agreed to settle these claims with a $484,800 settlement. The company settled similar claims with Florida plaintiffs last year.
Amica Mutual Insurance Co., based in Rhode island, was established in 1907 — making it the oldest mutual auto insurer in the country, according to the company’s website — and held 1.6 million policies as of the end of 2019.
Washington Class Members who submit a claim to the Amica insurance lawsuit settlement can recover cash payments from the settlement fund. Payments will depend on the amount of repairs that weren’t covered by insurance due to allegedly diminished values.
Additionally, exact payment amounts will vary depending on the number of claim forms filed by Class Members.
However, the settlement website notes payments are likely to be in the range of $550 per claimant.
Eligible Washington drivers can file a claim on the Amica diminished value settlement website using an ID and password sent with a settlement notice. Those who did not receive this information and believe they are eligible to file a claim with the Amica settlement may contact the settlement administrator via telephone or email.
The deadline for exclusion and objection in the settlement is Dec. 22, 2021.
The final approval hearing is scheduled for Jan. 21, 2022.
In order to benefit from the Amica diminished value settlement, Class Members must file a valid claim form by March 7, 2022.
