American consumers who were insured by Farmers and made property loss claims through Farmers Insurance Exchange, Truck Insurance Exchange, or others may be eligible to get a payment thanks to a recent $7 million class action lawsuit settlement.

Settlement Class Members include individuals with policies through Farmers Insurance Exchange, Fire Insurance Exchange, Mid-Century Insurance Co., Truck Insurance Exchange, or Farmers Insurance Co. of Arizona who paid general contractor’s overhead costs when making property loss claims between Dec. 13, 2013 and April 7, 2021.

Plaintiffs allege that Farmers was required to pay general contractor’s overhead and profit as a part of their covered damage claims. Farmers denies it should be held responsible for these fees and argues it acted properly under its insurance contracts and Arizona law. It does not accept liability for the plaintiff’s allegations.

The Court has not made a ruling in this case. Instead, Farmers and the plaintiffs agree the proposed settlement would resolve all claims.

According to the company’s website, Farmers was founded in 1928 and serves more than 10 million American households.

Class Members who file a claim are eligible for a payment in the form of a check.

Members can receive up to 53 percent of the unpaid general contractor’s overhead and profit Amount. Members cannot receive more than their policy limits. These payments will be mailed to each Class Member that files a timely and valid claim.

Class Members who do not want to remain in the Class and would rather seek recourse through an individual lawsuit later should ask to be excluded from the class action lawsuit. The deadline to file an exclusion is Sep. 27, 2021.

Class Members who want to remain in the Class but object to the current terms must list their objections in writing and send it to the court by Sep. 27, 2021.

Class Members who do not act at all will not be eligible to receive their share of the settlement fund but will still be bound by the terms of the agreement, so they will lose the right to pursue future lawsuits regarding this matter.

Eligible Class Members who want to get a payment must submit a timely claim.

The deadline to file a claim in the Farmers class action lawsuit settlement is 60 days after the Implementation date, or Feb. 8, 2022.
