Kane's Furniture settlement

A settlement has been reached in a class action lawsuit alleging Kane Furniture Corporation sold defective bonded leather furniture that peels, flakes and deteriorates.

If you purchased bonded leather furniture from Kane between July 27, 2010 and Dec. 5, 2016, you may be entitled to benefits from the Kane Furniture class action settlement.

Cliff Brown and Douglas Mincer filed the Kane Furniture class action lawsuit in October 2016. They lodged several allegations against the furniture company, claiming it sold defective bonded leather furniture; used defective bonded leather parts in attempt to repair the defective furniture; failed to honor its warranties on the sale of defective bonded leather furniture; failed to properly disclose to consumers that the bonded leather furniture was not genuine leather; and failed to comply with the terms of its sales contracts.

Under the terms of the Kane Furniture class action settlement, “bonded leather furniture” is defined as any piece of furniture sold by Kane that is covered (in whole or in part) with bonded leather on the seat backs, seats, arms and legs of the furniture.

Kane Furniture admits no wrongdoing but has agreed to settle the leather furniture class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Kane Furniture class action settlement was preliminarily approved on Dec. 7, 2016.

Class Members who would like to exclude themselves from the Kane Furniture settlement must do so no later than March 13, 2017. The objection deadline is April 11, 2017.

Who’s Eligible

Class Members of the Kane Furniture settlement include: “All persons who purchased Bonded Leather Furniture (‘Bonded Leather’) from Kane Furniture Corporation on or after July 27, 2010, and who have not already received an exchange, credit or refund of their Bonded Leather from Kane Furniture Corporation, or who do not otherwise opt out of this class action settlement.”

NOTE: Only the original purchaser of the bonded leather furniture products is eligible for benefits from the Kane Furniture class action settlement.

Potential Award

Under the terms of the bonded leather furniture settlement, Kane Furniture will offer compensation to claimants in the form of a cash payment or a voucher. Class Members who elect to submit a Claim Form are eligible for Class 1 benefits. Class Members who do not submit a Claim Form are eligible for Class 2 benefits.

Class 1: Provides benefits to Class Members who formally complained to Kane about any cracking, peeling or flaking of the bonded leather furniture. The benefits they are eligible to receive depends on when they made their formal complaint:

  • Within one year of the date of purchase: Class Members will be eligible to receive either a full cash refund or a 100 percent in-store credit for the full price of the piece of furniture and any payments made to Kane for repairs.
  • Within one to two years of the date of purchase: Class Members will be eligible to receive either a 50 percent cash refund or a 100 percent in-store credit for the purchase price of the furniture and any payments made to Kane for repairs.
  • More than two years of the date of purchase: Class Members who did not formally complain to Kane Furniture within two years of the date they purchased their furniture will automatically be covered by Class 2 and do not need to submit a Claim Form.

Class 2: Provides benefits to Class Members who do not submit a Claim Form. An in-store voucher will make up 60 percent of the compensation and the remaining 40 percent will be paid in cash. Class 2 benefits depend on the date the bonded leather furniture was purchased from Kane Furniture:

  • July 27, 2010 – Dec. 31, 2010: Class Members who purchased their furniture during this timeperiod will receive a return of 5 percent of the original purchase price.

NOTE: To receive benefits, Class Members who are still in possession of the furniture must make arrangements to return the bonded leather furniture to Kane Furniture. 1. Gina Esposito says:

Am I eligible for a claim if my furniture was just deemed part of this lawsuit, I didn’t have issues until the past 6 months, called Kanes and they sent an inspector out and advised that I needed to contact you regarding my claim. Please advise, thanks

  2. LEXX LUTHOR says:

    How much was it ?

    1. kevin says:

There have been no payments to anyone. The person said he was paid is a liar…..

      1. Zach s says:

Kevin, please review the most recent court docs. We received payment for class 1 plus accrued interest. Do your research before calling people liars.

  3. Zach S says:

Finally got payment on furniture as Class 1 member.

  4. ALICE NESS says:

I ALSO BROUGHT THE COUCH AND LOVESEAT AND THEY WERE WORSE THAN A SHAGGY DOG. I TO HAVE FILED AND BEEN TOLD ABOUT A CALL FOR A DEPOSITION AT ANY TIME OR PLACE THE NO GOOD LAWYERS SAY. IT HAS BEEN 6 TO 8 YEARS OF TOTAL BS. TOLD ME IF I HAD PICTURES TO GO AHEAD AND GET RID OF IT WHICH I DID IN MAY 2020. GET THE SAME CRAP EVERYONE IS GETTING. THERE SHOULD BE A LAW FOR LAWYERS BEING CROOKS AND HIDING BEHIND THE LAW.THEY SHOULD NOT HAVE RECEIVED A PENNY BUT INSTEAD THEY GOT AND ARE GETTING MILLIONS.

  5. Maria says:

Kane’s was my go-to store when it came to furniture. Have been buying since the mid ’80s. NEVER AGAIN will I set foot in that store. I too purchased the bonded leather couch and loveseat. I TOO sent them everything they requested of me. I TOO received a letter saying that I may be called on to do a deposition. I TOO have not received anything a check a followup from the attorney’s office. I TOO am very frustrated that we can’t get any updates or answers.

  6. T. S says:

Sent in pictures, and all documents requested. Complained about my 7 piece sectional within the first year. I’ve received the letter that I’m in the top class to receive 100% of my purchase in cash or store credit. Every time I call the toll free number I get a different story. I was even told Class A was back in court and Kane’s was fighting it again, blah blah blah. We have pictures and we’re told the same about throwing away our furniture, was recommended to do by the company. This whole thing makes me sick and I’ve told everyone I know to not purchase from Kane’s until they fix the issue by keeping their word and not using SH!T materials for their furniture. I’ve been waiting since 2014 some an action on their part!!!!

    1. Sharon Leonard says:

Today is July 19, 2020, and we are still awaiting some type of contact regarding this class action suit. I have pictures, I have called and gotten a million stories, and we received a notice that we will be getting a letter to appear in court earlier this year and nothing has come of that either. How does Kane’s Furniture continue to have advertisement on television and can’t pay the customers they duped? I finally couldn’t take the ugly peeling furniture anymore and threw it out and got a new set in May from another furniture store. I will never go to Kane’s Furniture again and I will share with everyone I know not to shop there either.

  7. ALICE G. NESS says:

I BROUGHT THIS FURNITURE BEFORE CHRISTMAS IN 2012. IT IS WHAT MY HUSBAND LIKED. IN THE NEXT YEAR IT STARTED SHEDDING. IT STARTED JUST PEALING OFF. I CALLED KANES AND GOT NOTHING SO I CONTACTED THE COMPANY THAT BUILT IT AND THEY SENT ME WHAT WAS TO BE LEATHER BUT TURNED OUT TO BE THE SAME THING THAT WAS ON IT. SPENT CLOSE TO $500 TO HAVE IT PUT ON 3 DIFFERENT TIMES AND IT STILL PEALED. I CALLED THE 800 NUMBER AND THEY TOLD ME THAT I COULD THROW IT AWAY SINCE I WAS STORING IT FOR THE LAST 5 YEARS AND HAD PICTURES OF IT. THAT I HAD TO DO NOTHING ELSE BUT WOULD RECEIVE THE SETTLEMENT SINCE I COMPLAINED WITHIN THE FIRST YEAR. IT IS NOW 2020 AND I HAVE RECEIVED NOT A DIME OR ANYTHING ELSE. LAWYERS ARE MAKING A KILLING WHILE WE GET MESSED OVER.

    1. Roger Brady says:

Still haven’t heard anything …..heard settlement is complete …

    2. Sharon Leonard says:

In the same boat as you, on July 19, 2020. This is ridiculous. Lawyers shouldn’t have gotten paid until all customers got their refunds. I sent an email to Channel 9 News to see if they can help my husband and me get our money back.

  8. Susan says:

Waiting, waiting, waiting. I have done everything thing I was asked to do. I need my settlement money!! What can I do? Call State of Florida Attorney General????!

  9. Johnny says:

Please help with ANY info. Says settlement is closed but last I heard is I might get contacted for a deposition. Is this ongoing? Have they found a way to get out of reimbursing their customers?
