Kane's Furniture settlement

A settlement has been reached in a class action lawsuit alleging Kane Furniture Corporation sold defective bonded leather furniture that peels, flakes and deteriorates.

If you purchased bonded leather furniture from Kane between July 27, 2010 and Dec. 5, 2016, you may be entitled to benefits from the Kane Furniture class action settlement.

Cliff Brown and Douglas Mincer filed the Kane Furniture class action lawsuit in October 2016. They lodged several allegations against the furniture company, claiming it sold defective bonded leather furniture; used defective bonded leather parts in attempt to repair the defective furniture; failed to honor its warranties on the sale of defective bonded leather furniture; failed to properly disclose to consumers that the bonded leather furniture was not genuine leather; and failed to comply with the terms of its sales contracts.

Under the terms of the Kane Furniture class action settlement, “bonded leather furniture” is defined as any piece of furniture sold by Kane that is covered (in whole or in part) with bonded leather on the seat backs, seats, arms and legs of the furniture.

Kane Furniture admits no wrongdoing but has agreed to settle the leather furniture class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Kane Furniture class action settlement was preliminarily approved on Dec. 7, 2016.

Class Members who would like to exclude themselves from the Kane Furniture settlement must do so no later than March 13, 2017. The objection deadline is April 11, 2017.

Who’s Eligible

Class Members of the Kane Furniture settlement include: “All persons who purchased Bonded Leather Furniture (‘Bonded Leather’) from Kane Furniture Corporation on or after July 27, 2010, and who have not already received an exchange, credit or refund of their Bonded Leather from Kane Furniture Corporation, or who do not otherwise opt out of this class action settlement.”

NOTE: Only the original purchaser of the bonded leather furniture products is eligible for benefits from the Kane Furniture class action settlement.

Potential Award

Under the terms of the bonded leather furniture settlement, Kane Furniture will offer compensation to claimants in the form of a cash payment or a voucher. Class Members who elect to submit a Claim Form are eligible for Class 1 benefits. Class Members who do not submit a Claim Form are eligible for Class 2 benefits.

Class 1: Provides benefits to Class Members who formally complained to Kane about any cracking, peeling or flaking of the bonded leather furniture. The benefits they are eligible to receive depends on when they made their formal complaint:

  • Within one year of the date of purchase: Class Members will be eligible to receive either a full cash refund or a 100 percent in-store credit for the full price of the piece of furniture and any payments made to Kane for repairs.
  • Within one to two years of the date of purchase: Class Members will be eligible to receive either a 50 percent cash refund or a 100 percent in-store credit for the purchase price of the furniture and any payments made to Kane for repairs.
  • More than two years of the date of purchase: Class Members who did not formally complain to Kane Furniture within two years of the date they purchased their furniture will automatically be covered by Class 2 and do not need to submit a Claim Form.

Class 2: Provides benefits to Class Members who do not submit a Claim Form. An in-store voucher will make up 60 percent of the compensation and the remaining 40 percent will be paid in cash. Class 2 benefits depend on the date the bonded leather furniture was purchased from Kane Furniture:

  • July 27, 2010 – Dec. 31, 2010: Class Members who purchased their furniture during this timeperiod will receive a return of 5 percent of the original purchase price.
  • Jan. 1, 2011 – Dec. 31, 2011: Class Members who purchased their furniture during this timeframe will receive a return of 7 percent of the original purchase price.
  • Jan. 1, 2012 – Dec. 31, 2012: Class Members who purchased their furniture during this timeframe will receive a return of 10 percent of the original purchase price.
  • Jan. 1, 2013 – Dec. 31, 2013: Class Members who purchased their furniture during this timeframe will receive a return of 12.5 percent of the original purchase price.
  • Jan. 1, 2014 – Dec. 31, 2014: Class Members who purchased their furniture during this timeframe will receive a return of 15 percent of the original purchase price.
  • Jan. 1, 2015 – Dec. 31, 2015: Class Members who purchased their furniture during this timeframe will receive a return of 25 percent of the original purchase price.
  • Jan. 1, 2016 – Dec. 31, 2016: Class Members who purchased their furniture during this timeframe will receive a return of 100 percent of the original purchase price.

NOTE: To receive benefits, Class Members who are still in possession of the furniture must make arrangements to return the bonded leather furniture to Kane Furniture. Class Members who are no longer in possession of the bonded leather furniture and who have certified as such under penalty of perjury do not need to make arrangements to return the furniture.

Proof of Purchase

N/A. Claimants must attest under the penalty of perjury that they complained to Kane Furniture Corp. about the peeling, cracking or flaking of the bonded leather furniture within two years of the date of purchase.

    Our furniture was purchased/delivered 02/01/2014. We have 2 lounge chairs and a loveseat. One power lounge chair is used more often than the other pieces. We purchased a warrant package on each of the three pieces I believe to the tune of $100.00 each. When the furniture started to peel, we were told that was not part of the warranty for “guaranteed for life.” Now the power has gone out on the chair and they will come to fix that. I guess there is no recourse for the condition of this furniture used by an elderly couple, no children or pets.

    I filed a Proof of Claim on 2/16/17. It has now been over two years and I have heard nothing! I’m reluctant to get rid of this piece of furniture; however, it is an embarrassment to have it seen in my living room. Are there any current updates? When can I dispose of this piece of junk?

    I haven’t heard anything about the status of the settlement I still have the furniture it’s all peeling it so embarrassing it Hass to be covered with chair covers

    Can you please tell me the status of my claim. it should be a class 1, I know part of the delay is because I didn’t have a name, the first call was to the sales man of purchase, desk and the person that came to the resident at least 4 or 5 times, also they said they had to send to China for cover replacement which took at least 6 weeks to come back. Which he worked out the Tampa office they send out to repair.

      From what we can tell, Kane’s has challenged several of the claims. There is currently a status hearing scheduled for 3/11/19.
