Sun Pharmaceutical Industries Inc. and Taro Pharmaceuticals U.S.A. Inc. have agreed to a $200 million class action settlement to resolve claims they participated in an alleged scheme involving the pricing of certain generic drugs.
The generic medication settlement benefits consumers and third-party payers who indirectly purchased, paid for or provided reimbursement for certain generic prescription drugs between May 1, 2009, and Dec. 31, 2019. Eligible consumers generally purchased the drugs through pharmacies or mail-order pharmacies, while third-party payers may include insurers and self-funded employer health plans.
This settlement is part of the multidistrict litigation In re Generic Pharmaceuticals Pricing Antitrust Litigation, MDL No. 2724, pending in Pennsylvania federal court. The MDL includes antitrust claims involving multiple generic drug manufacturers and different groups of purchasers.
The Sun Pharmaceutical/Taro Pharmaceuticals agreement is separate from other settlements in the MDL, including earlier agreements involving direct-purchaser claims against Sun Pharmaceutical and Taro Pharmaceuticals and end-payer claims against Sandoz and Fougera. This settlement resolves end-payer claims against Sun Pharmaceutical and Taro Pharmaceuticals brought by consumers and third-party payers.
According to a class action lawsuit, generic drug manufacturers, including Sun Pharmaceutical and Taro Pharmaceuticals, engaged in an alleged scheme to fix, maintain and stabilize prices, rig bids and allocate markets and customers for certain generic drugs. Plaintiffs allege the conduct harmed competition and caused consumers and third-party payers to overpay for the drugs.
Sun Pharmaceutical and Taro Pharmaceuticals have not admitted any wrongdoing but agreed to a $200 million class action settlement to resolve the allegations.
Under the terms of the generic medication settlement, eligible class members who submit valid claims can receive a pro rata share of the net settlement fund. The proposed allocation plan provides that payments are generally based on the amount spent on the named generic drugs during the class period.
No specific payment estimate is available at this time. The final amount each claimant receives will depend on factors, including eligible purchases and the number of valid claims submitted.
The deadline for exclusion and objection was Dec. 2, 2025.
The final approval hearing for the generic medication settlement happened on Jan. 15, 2026.
To receive class action settlement benefits, class members must submit a valid claim form by Nov. 9, 2026.
Who’s Eligible
The generic medication settlement benefits individuals and entities in the 50 United States, except Indiana and Ohio, as well as the District of Columbia, Puerto Rico and the U.S. Virgin Islands, that indirectly purchased, paid for or provided reimbursement for some or all of the purchase price of one or more named generic drugs, other than for resale, between May 1, 2009, and Dec. 31, 2019. A list of the named generic drugs can be downloaded from the notice section of the website.
