$275M Sandoz and Fougera antitrust class action settlement

Sandoz Inc. and Fougera Pharmaceuticals Inc. have agreed to a $275 million class action settlement to resolve claims they engaged in a conspiracy to raise and fix the price of generic drugs.

The generic drug settlement benefits consumers and third-party payers who purchased, paid for or provided reimbursement for generic drugs from Sandoz or Fougera between May 1, 2009, and Dec. 31, 2019. A full list of named generic drugs is available on the settlement website.

Plaintiffs in the generic drug price-fixing multidistrict litigation (MDL) claim generic drug manufacturers, including Sandoz and Fougera, worked together to raise and fix the price of generic drugs. As a result, consumers and third-party payers allegedly overpaid for these drugs.

Sandoz is an independent Swiss generic pharmaceuticals manufacturer, formerly a subsidiary of Novartis AG until October 2023 and the parent entity of Fougera Pharmaceuticals.

Sandoz and Fougera have not admitted any wrongdoing but agreed to a $275 million class action settlement to resolve the allegations.

Other ongoing settlements also include a $1 million payout to drug dispensers, including hospitals and independent pharmacies. In 2024, Sun Pharmaceuticals and Taro Pharmaceuticals agreed to pay a combined $85 million settlement to resolve allegations that they fixed prices on certain generic drugs.

Under the terms of the Sandoz generic drug settlement, class members can receive a cash payment based on the amount they paid for generic drugs during the class period. Class members who paid more for covered drugs will receive a larger share of the net settlement fund. Exact payment amounts will vary.

The deadline for exclusion and objection was May 9, 2025.

The final approval hearing for the generic drugs price-fixing settlement happened on July 23, 2025.

To receive settlement benefits, class members must submit a valid claim form by Nov. 9, 2026.

Who’s Eligible

The generic drug class action settlement benefits all persons and entities in the 50 United States (except Indiana and Ohio), the District of Columbia, Puerto Rico and the U.S. Virgin Islands that indirectly purchased, paid and/or provided reimbursement for some or all of the purchase price for any named generic drugs, other than for resale, from May 1, 2009, to Dec. 31, 2019. Consumers and third-party payers can check their eligibility by entering their information on the settlement website.

Consumer and third-party payers must provide the name of the pharmacy or mail-order pharmacy from which they purchased the generic drugs, the date of the purchase, the prescription number, the total amount paid out of pocket and/or the amount paid by their health insurance plan, if any, for each prescription, and the total amount paid for all prescriptions during the class period.
