UPS Falsified Delivery Reporting Claims Overview: 

  • Who: United Postal Service (UPS) has agreed to pay $5.3 million to resolve claims made by the U.S. Department of Justice (DOJ). 
  • Why: The DOJ claimed UPS falsified electronic time stamps for deliveries to foreign posts that it was contractually obligated to provide the U.S. Postal Service, which it proceeded to incorrectly bill. 
  • Where: UPS operates nationwide. 

United Parcel Service (UPS) has agreed to pay $5.3 million to resolve allegations by the U.S. Department of Justice (DOJ) that the shipping company lied to and incorrectly billed the U.S. Postal Service (USPS). 

The DOJ claimed UPS violated the False Claims Act by falsifying the electronic time stamps for U.S mail deliveries to foreign posts while still billing the USPS.

Specifically, the DOJ alleged UPS was dishonest about both the time it transferred possession of the mail and that it was doing so. 

UPS, which has been contracting with USPS to make deliveries since 2009, does not admit any fault by agreeing to the settlement, according to the DOJ, which, similarly, does mot acknowledge that its claims are unsupported by agreeing to the settlement. 

UPS’ contract with USPS requires it to submit electronic notices when it drops off an item at a specific location for the company to get paid for the delivery. 

UPS Would Face Penalties If It Made Untimely Deliveries

Under the terms of its contract, UPS would get penalized if it made deliveries that were untimely or if an item ended up getting delivered to the wrong place, according to the DOJ. 

The alleged false delivery scans were done between April 2010 and December 2016, according to the DOJ. 

By coming to the agreement, claims of breach of contract, unjust enrichment, fraud, payment by mistake and those under the False Claims Act and the Program Fraud Civil Remedies Act were dropped by the government. 

Claims against UPS regarding criminal liability, defective products of services, liability for failure to deliver goods or services, liability for personal injury or property and liability for express or implied warranty remain despite the settlement. 

A class action lawsuit was filed against UPS in November by female employees claiming the company systematically discriminated against them based on their gender, age and disability.

    I can’t believe this is happening. I paid $75 to over night some personal documents for my entire family birth certificate, social security cards, passport etc. which had a tracking number on it. The driver still managed to deliver it to a unknown address. I’ve called spoke to numerous supervisor “NO HELP” they can’t find we’re my envelop was left all they want to do is give me a refund for my $75 I’m so frustrated.

    Its happens all the time..in the last 2 weeks it showed 5 packages delivered an they not only never were..they were sent back. They need to include 2022. UPS has been doing this for a long time..but now even worst. Blaming short staffing etc. Even went to ups to try an retrieve our packages..they said , they didnt know what truck they were on.. requested them to be left for pickup etc..got every run around possible till they went back. An all of they were ” so called delivered ” this didnt just happen to me..it was our whole neighborhood!!

    Add me. We’ve had many delivery problems and tracking g problems due to erroneous delivery info from FedEx.
