Verizon Wireless is facing a new class action lawsuit from a customer who says the company adds extra charges to his bill for services without properly notifying him or providing him an adequate contract in writing.

By adding the services without sending him a written contract to agree to, and in light of the company’s push to convince customers to choose paperless billing, Verizon is putting consumers at a disadvantage that violates New Jersey’s Consumer Fraud Act, plaintiff Stephen Simoni says.

Simoni, who lives in Wyoming, filed the class action lawsuit and is seeking to represent a Class of consumers from his home state who had similar charges on their Verizon bill within the last six years. He is unsure at this point how many potential Class Members there might be, but estimates there are “most likely many thousands.”

According to Simoni, one of his wireless phones got damaged between November and December 2019 and he initiated a claim for insurance coverage through Verizon’s carrier, Asurion.

While working with an Asurion agent to process the claim, the agent solicited Simoni to purchase a monthly “Smart Home Support” protection plan, he says. The plan would reportedly cover more than just Simoni’s phone — it would offer him protection for various other household devices that operate with Verizon’s wireless service.

Simoni says Asurion told him he would receive an email explaining more about the plan and its terms and said he could cancel it at any time, the procedure for which would also be outlined in the email.

The plaintiff says he never got a “confirmation of sale” for the protection plan, but Verizon added the monthly Asurion charge to his Verizon bill without him realizing it.

“Verizon did not adhere to its well-established policy of sending consumers a notification of the new ‘Next Bill Summary’ caused by the addition of the new charge,” his class action lawsuit says.

Simoni says he became aware that he had been charged for the plan nearly a year later when he got a paper receipt and account summary while purchasing a new wireless phone.

He later contacted Verizon and demanded reimbursement. The company “only provided a minimal refund and blamed [him] for not having read his monthly paperless bills.”

The Verizon bill class action lawsuit was originally filed in state court in New Jersey on Nov. 30. This month, lawyers for Verizon moved to have the case transferred to federal court. Now it is being considered by the U.S. District Court for the District of New Jersey.

    Recently became aware that Verizon was charging my account for Global Calling Plus (a 15 dollar charge hidden in the bill) for over 4 years. When they were confronted, they blamed everyone but themselves for their error. Only offered to reimburse 3 months of charges and rebuffed refunding or crediting 4 years of erroneous charges. I’d imagine I am not the only customer who is being defrauded by Verizon over an erroneous Global Calling Plus charge.

    Verizon, removed my global calling from my plan without notification and charged me near 6000 for global calling

    Switch to mint mobile 15 dollars a month. Same towers, I did it 2 years ago. 180 a year.. kept my number and phone.

    I did a trade in for a new phone last week. They said the only change my bill will have is a $35 activation fee. Guess what, that fee was $198! They added a new line to my account without my consent! And my next bill is another $100 extra as well. Shame on Verizon!

    I went to Upgrade a phone. After telling rep that we started a business she wanted to check on a business acct. I told her I did t want to do that after she explained the upfront cost and told them no thank you and to just do upgrade. I the mean while she began adding new numbers and to this day I have still been paying on explained to her that I only request my upgrade. PHONES bought for these two line 0 but she added phones and I never received PLUS INSURANCE THRU INSURION ON both phones. I asked them to stop many many times and they told me that since I paid my bill they could not resolve. To this day I am still paying on these phones after speaking w a rep 10 mins ago!

    YES! did that to me too! Only refunded a portion of what they charged. When I discovered the charge, I thought what the heck and because they said it would cover all electronics, but did NOT explain that there was also an EXTRA charge for repairs. I tried to file a claim on a printer, which they said would cost an additional $100 to repair.

    I am so tired of paying for no service. They have been stealing my money every month and offer nothing for Data (even though i have unlimited). So when my phone wont work all day except for texting which i dont even care about. I get charged 100 dollars for nothing I signed up for then all of a sudden there is a “content” charge??? With zero notice at all they try to sneak a 10 dollar charge on my phone. This is disgusting and we need to make sure that they not only pay it all back like in 2015 BUT this time it has to really hurt them. They are criminal and need punishment. The settlement for us needs to be in the billions. They need to get hurt by this next fine. They don’t deserve to serve the American people.

    is this lawsuit still active?, if yes, how would I go about joining it?
    I am a Verizon wireless customer who is being charged for an ‘add-on’ I did NOT request and did NOT authorize. I have contacted Verizon on multiple occasions to have the charge removed and it keeps being added back in every month. When I request to be refunded for the fraudulent charge (for which I was told was removed the month before) they say they are unable to do that. If this lawsuit is still pending, please contact me.
