GEICO Faces Class Action lawsuit Alleging Excessive Premiums During Pandemic

GEICO has unfairly profited off the coronavirus pandemic, raising premiums despite the fact there was a huge drop in auto accidents, a new class action lawsuit alleges. 

Plaintiff Richard Rose filed the class action lawsuit against GEICO Casualty Company, GEICO Indemnity Company and GEICO General Insurance Company Friday in a Mississippi federal court. 

“While most companies, industries and individuals have suffered because of the COVID-19 pandemic, auto insurers like GEICO have scored a windfall,” the class action alleges.

Due to stay at home measures enforced across the country, the claim states, there has been a dramatic reduction in driving, and therefore a reduction in driving-related accidents. 

As a result of the decrease in driving and accidents, the premiums charged by auto insurance companies like GEICO during the pandemic are “unconscionably excessive,” according to the class action. 

Rose cites one published report that conservatively calculates that at least a 30 percent refund of premiums would be required to make up for the excess amounts paid by consumers from March to April 2020. 

“Despite full knowledge of these facts, GEICO has continued to charge and collect excessive premiums, and has failed to issue adequate refunds,” the class action lawsuit states. 

Rose says GEICO has a “Giveback” program that applies a 15 percent discount or credit on new and renewal auto policies, but it is “woefully inadequate” to compensate for the excessive premiums customers have already paid as a result of COVID-19.

He alleges GEICO has violated federal and Mississippi laws through its conduct. 

In his case, Rose says when he renewed his car insurance policy for two vehicles through GEICO in July 2020, his premium went up by over $100 over six months. 

He says this happened despite the “drastic decrease” in travel and automobile accidents during 2020. 

Rose is looking to represent all Mississippi residents who bought auto insurance from GEICO from March 2020 to now. He is suing for breach of contract, breach of the duty of good faith and fair dealing and unjust enrichment. 

Rose is seeking certification of the class action, an injunction, damages, disgorgement of profits, fees, costs and a jury trial.

    Geico gave a 10 or 15% credit during the pandemic then Jacked the rates up. When I called question as they said more people were driving and there were more accidents.

    My insurance premiums went up during the pandemic and are still going up even after they found out that I wasn’t driving two of the four cars on my policy. My premiums then went down for a month and then the company jacked the premium back up more than before saying that due to supply and demand and microchip shortage that that’s why the rates are increasing. I don’t understand this and would like to be added to the lawsuit because I’ve been a customer for almost 3 years.

      I called GEICO regarding my insurance and why rates went up. I was told because there are more accidents in my state and the rates needed to go up. I asked him, so I’m paying for other peoples accidents although I have had none? He said that was the way it goes. Man.. I thought that is why rates go up on those who have had accidents, not those who do not.

    Yes, I agree, GEICO’s rates never went down during the whole 2 years of the COVID pandemic. I talked to a representative and asked why my rates would remain the same even though I am not driving as much. Also, I am retired. The only places I go are to the grocery store, Walmart, drug stores. I drive on a whole tank of gas for 1 month and a half.

      Add me to Gieco please. They increased my premium to a ridiculous amount after they stated that my payments would be a certain amount. I disclosed everything and according to them ran my record, after they realized that I had my license previously suspended (like 3 yrs before briefly for a ticket non payment). So after this was “discovered” they jacked up my payments to over double what I was paying. I was so fed up that I canceled my policy. I told them when I was at my time to cancel. I asked the agent when I could cancel with no fees or penalties. Well later I received a bill for fees for my cancellation. I tried to talk to them, taking to this person and that person but no one could help and I had to pay. Long story short, this ended up going to collections and damaged my credit. So happy to see this company is finally going to court over their scams!
