RSH Travel Inc. d.b.a CheapOair has been hit with a class action lawsuit accusing it of charging customers who book travel through its websites and mobile applications a higher price than the price listed as the “Final Total Price” on the website or app.

CheapOair markets itself as a company that offers “one of the largest selections of airfares, hotels, car rentals, vacation packages and travel deals obtained from multiple sources.” The company also touts discounted flights, low airfare guarantees and discounted hotel rates.

“As a one-stop travel solution, we offer consumers the ability to research, plan and book airfare, vacation packages, hotel rooms and car rentals,” the CheapOair website states.

According to the CheapOair class action lawsuit, RSH advertises a price on its websites and apps as the “Final Total Price.” However, once the customer’s payment is processed, RSH allegedly sends a confirmation email that lists the amount as “Total Charge” instead of “Final Total Price” and subsequently charges the customer’s credit card an even higher price.

This process violates the Civil Code of Quebec and Canada’s Competition Act, the CheapOair class action lawsuit says.

On March 1, the plaintiff says he made a reservation on www.cheapOair.com for his family of four to fly from Montreal to Paris. The final price for the four tickets was reportedly $1,688.94. Immediately after he submitted his payment information to purchase the tickets, he received a Booking Confirmation that confirmed “Total Charge: C$1688.94.” 

However, the Visa credit card he used to make the purchase was reportedly charged $1,723.06 for the same booking, and on March 2, the credit card was allegedly charged an additional $17 for the same booking. In total, the plaintiff says he was charged $51.12 more than the final price he expected to be charged.

According to the CheapOair class action lawsuit, RSH Travel’s practice of charging these undisclosed prices violates its own terms and conditions. The plaintiff points to a section of the terms and conditions which state: “Important Note: All service fees are subject to change without notice. YOU WILL BE CHARGED THE FINAL TOTAL PRICE AS QUOTED REGARDLESS OF ANY CHANGE OR VARIANCE IN THE SERVICE FEES.”

The plaintiff says he’s not the only CheapOair customer to experience unexpected charges. He says he personally knows of one other person who experienced a similar situation. Further, he points to a number of complaints posted on the website www.complaintwire.org from customers who were allegedly charged unexpected fees when they purchased tickets from CheapOair.

According to the CheapOair class action lawsuit, one angry customer wrote: “they charged me the fees for air ticket, then an additional 25 $ airline taxes and fees! Another angry customer had a similar complaint and posted, “Same here. Used Cheapo for several years with great success and without additional fees that were not documented in the initial agreement. Now I’m charged $33 extra as a ‘Service Fee,’ which Cheapo took the liberty of adding to my credit card without my knowledge or agreement. No more Cheapo for me.”

Proposed Class Members of the CheapOair ticket price lawsuit include all Canadians who, since March 10, 2017, made a travel booking using any of RSH Travel’s websites or mobile applications and who were charged a higher price than the price initially displayed as the final price. 

RSH Travel’s websites include CheapOair.ca, CheapOair.com, Onetravel.ca and Onetravel.com.

The CheapOair class action lawsuit seeks reimbursement of the price difference between the “Final Total Price” that was listed and what the Class Members were actually charged.

In addition, the CheapOair class action lawsuit seeks $20 million in punitive damages.

The plaintiff estimates that tens of thousands of Canadians may qualify as Class Members of the CheapOair lawsuit.

In addition to punitive damages and reimbursement of the undisclosed fees to eligible Class Members, the CheapOair class action lawsuit has asked the court to order RSH Travel to stop charging customers a higher price than the listed “final” price for the ticket.

    I purchased a ticket on May 40th, 2023. Something unexpected came up and I had to cancel. The Indian rep told me I had to pay 300.00 in cancelation fees….

    I bought an insured ticket and my things were stolen in the airport so I was unable to fly. After that traumatic incident, Cheapoair have rubbed me a second time. Cheapoair claimed they refunded the money and it can’t be traced. The account they claim they returned the money to does not exist and even the bank told them there is not trace of the money. The bank said they are lying and if they did indeed return the money then they can cancel it and re-issue the check but they refused. One of their agents told me I should just forget my $1200. Now they simply leave me on hold for hours and then hang up on me. How do I get my money back from these thieves?

    I had the same issue with CheapOair. After we booked the airline tickets with a CheapOair agent on 02/05/2023, they continued to charge my husband’s credit card for additional two different charges on a different date. On 02/26, there were two unauthorized additional charges, including $86.06(service and tax) and an unknown charge of $148.99(agent service charge?). The CheapOari’s agent in India didn’t mention those fees when he was helping me to purchase the airline tickets and check the hotel rates. CheapOair’s customer services are horrible. They lied to you. In the end, you paid much more than the other third party online booking websites because they charged you additional service fee without acknowledging you before you gave them your credit card information. We didn’t know about those charges until a few days ago after we came back home on May 18th from our trip to Italy for 18 days. Please help us bring justice to get our money back! We will never do business with CheapOair any more!

    I recently purchased 2 tickets for me & my daughter to fly to from St. Louis to Brussels. I paid for the insurance that stated I can cancel for any reason. When I contacted Cheapoair I was told that I have to contact the airlines to be refunded my money; however that was the was not the truth. The insurance that I paid for through Cheapoair said that I may cancel for any reason and will receive 80% of refund. I spoke with 3 people from
    Cheapoair that gave me the run around told me once I cancel with them the airline would refund me, that was a lie. They sent me an email saying that my cancellation went through but I will not receive any refund. Total fraud. I spent $3600 on tickets that I should have received at least 80% like the insurance said.

    My daughter reserved a car through them, they set it up through Thifty, when she arrived to pick up the car she was told they did not have a reservation for her. Cheapoair still took her money 343.00 and DID NOT PROVIDE HER WITH ANYTHING!! They stole from her and will not help us. We have called them over and over!!! DO NOT USE THEM!!

    I recently purchased tickets for flights in June of 2023 with cheap o air. They insisted I buy cancel for any reason but would still only get 80 percent of my money returned. I wanted to upgrade my seats on two of the flights and a cheap o air ant said I would need to do that through the airlines so, I went online and it appeared the airline was going to take the extra charge out of my account, however, the money pending went back to my account and cheap o air said I had canceled my flights which was a total lie. I’ve talked to numerous agents over 5 days and they sent confirmation that I still have my flights, but when I go to the airlines with the confirmation number, they have no record of me on these flights. It is so annoying and time consuming and it appears that cheap o air just wanted to steal 20 percent of my money hoping I would cancel. At this time, I am still trying to speak with a supervisor or anyone at cheap o air that will correct this, but it looks like they will not. The airline seems to think they did nothing wrong and cheap o air seems clueless to just issue a different confirmation number for these flights. Never use a booking agency you aren’t absolutely sure is credible..
    Cheap o air is nothing but a money making racket because they have done Nothing to fix this and all I wanted to do was upgrade my seats and now I’m no longer listed on these flights and the airline doesn’t show me as a passenger but cheap o air tells me I’m confirmed….absolutely 💯 madness.

    Sept 29th flew to Texas through Cheapoair and it was the worst experience ever. Over charged and forced to buy checked bag at departure

    I might qualify since I didn’t pay as much attention about that practice. However last time, and that was 3 days ago, I made a reservation and I believe they have listed that charge as booking agent fee.

    There are several more problems that I have with that company going on today and I expect to get the justice.
