Depite a recent Bloomberg report, Bayer has not proposed a settlement to bring an end to U.S. claims of Roundup cancer, mediator Ken Feinberg notes.

Contrary to rumors about Bayer’s plans for ending the Roundup litigation, the company has not proposed a settlement to bring an end to U.S. claims of Roundup cancer, mediator Ken Feinberg notes.

Feinberg’s comment comes after a Bloomberg report claiming that Bayer may be set to pay around $6 to 8 billion to settle more than 18,000 Roundup Monsanto claims. Bayer has not commented on the report or Feinberg’s response.

The most recent official information from Bayer itself is from last week, when Bayer Chief Executive Werner Baumann said that the company would consider a Roundup settlement on “reasonable terms,” provided it “achieves finality of the overall litigation.”

Monsanto Litigation Blamed for Drop in Bayer Stock Value

Since Bayer AG bought Monsanto, the maker of the controversial herbicide Roundup, there has been considerable upheaval for the company’s shares. Bayer bought Monsanto for $63 billion last year, despite the pile of litigation tied with its Roundup product.

Thousands of lawsuits have been filed by plaintiffs who developed non-Hodgkin lymphoma after using Roundup. Indeed, Roundup has been declared “probably carcinogenic to humans” by a number of major organizations, including the World Health Organization’s International Agency for Research on Cancer. Certain other organizations, including the EPA, consider Roundup instead to likely be non-carcinogenic.

In the last year, Bayer’s shares have diminished by about a third of their value, equal to approximately $34 billion. This sharp decrease has been emerging since August 2018, when a California jury found in the first such Roundup Monsanto lawsuit that the company should have warned about Roundup’s alleged cancer risks. Indeed, the initial glyphosate rulings—none of which have been in Bayer’s favor—have at some points dropped the company’s market value below what it actually paid for Monsanto.

Settlement negotiations may well be tricky for Bayer. “The problem is, how do you get the plaintiffs to climb down from their very high expectations?” one source familiar with the matter told Reuters. “None of the jury verdicts so far have been favorable for Bayer.”

The lawsuits set to be heard next have been postponed until early 2020. According to Bloomberg, Bayer had pursued the delays in an effort to allow settlement discussions to continue undisturbed by ongoing trials. Bayer has previously stated that it plans to appeal, hoping that U.S. appeals courts would either reverse or at least tone down the three first Roundup court rulings, which initially offered awards of tens of millions to each plaintiff.

Bayer maintains that the glyphosate found in its Roundup product is safe.
