A hand holds an ear of corn in a field.After losing at more than one Bayer Roundup trial, the company says it’s expecting even more claims from Roundup users who developed cancer.

The first Bayer Roundup trial concerned landscaper Dwayne L. Johnson—a litigant claiming his non-Hodgkins lymphoma was a direct consequence of using Roundup products with glyphosate. As indicated by USRTK.org, this initial trial in August 2018 resulted in $289 million in damages. While this award was later significantly reduced to a total of $78 million, it gave many sick Roundup users hope that recourse might be available.

The second Bayer Roundup trial involved plaintiff and landowner Edwin Hardeman, also a non-Hodgkins lymphoma sufferer. He filed in February 2016 and his case went before a jury in March of 2019, resulting in $5 million in compensatory damages and $75 million in punitive damages.

The third Bayer Roundup trial concluded the previous day resulting in a massive $2 billion award to the plaintiff couple—Alva and Alberta Pilliod. The couple alleged the herbicide caused both of them to develop non-Hodgkins lymphoma. This lawsuit decision in California State Court followed two other California-based cases in which the jury favored plaintiffs with sizable payouts.

Bayer’s Outlook Hampered by Sheer Number of Litigants

Bayer is now close to completing their third quarter this year and anticipates a rapid increase in the sheer numbers of Roundup litigants in the U.S., according to the St. Louis Post-Dispatch.

The Germany-based pharmaceutical and agricultural product giant doesn’t attribute any merit to claims that glyphosate may cause cancer.

In July 2019, Bayer reported 18,400 pending cases. Towards the end of this month, it is hoped that the company–which acquired Monsanto in a $63 billion merger in June 2018—will offer an update of this figure. In an independent analysis strictly focused on data generated by courts in the state of Missouri, JP Morgan predicted a rise in the number of Roundup lawsuits to 45,000.

Appeals and Postponement

While Bayer has filed appeals in all the cases that have resulted in plaintiff awards, the monetary toll on the business has been significant. As indicated in a separate report by Yahoo Finance, $30 million in market value has been lost over the course of the year, and shareholders have allegedly been in revolt against management. Investors question corporate officers’ decision making process when deciding to acquire Monsanto.

Since recent lawsuits slated for trial have been postponed into 2020, it is believed that Bayer is starting to negotiate an overall settlement using a well-known mediator. While they don’t claim wrongdoing, failure to do so will likely cost significantly more than the estimated $2.5 to $20 billion that may be required to settle pending cases in the U.S.
