Beltone class action lawsuit overview:

  • Who: Plaintiffs Aaron Liebman and Martha Liebman filed a class action lawsuit against GN Hearing Care Corp., doing business as Beltone Electronics. 
  • Why: They claim Beltone fails to inform customers that their Beltone warranties are subject to a deductible.
  • Where: The Beltone class action lawsuit was filed in Illinois.

GN Hearing Care Corp., doing business as Beltone Electronics promises free warranty coverage but does not inform customers that they will be required to pay a deductible for warranty or repair claims, a class action lawsuit alleges.

Plaintiffs Aaron Liebman and Martha Liebman of New Mexico say that Beltone is able to sell more products and charge a higher price for them based on its misleading promise of free warranty coverage.

The Beltone class action lawsuit says Beltone sells hearing aids through a network of more than 1,500 Beltone “Hearing Care Centers” throughout the United States.

Beltone allegedly advertises its hearing aids as coming with a “standard manufacturer’s warranty” and coverage for lost, stolen or damaged hearing aids.

“Beltone’s advertising materials fail to state that Beltone’s warranties are subject to deductibles, such that customers will be required to pay all or a portion of their warranty repairs out of pocket,” the Beltone warranty class action lawsuit says.

Beltone warranty agreement failed to disclose repairs were subject to $300 deductible, plaintiffs say

Each plaintiff reportedly purchased a Beltone hearing aid in August 2017 that included the promise of a free three-year warranty. Within this Beltone warranty period, each plaintiff brought their hearing aids to a Beltone provider for repairs and were allegedly informed the repairs were subject to a $300 deductible.

They claim that the agreements they received when purchasing their hearing aids did not mention any limitations to the warranty or loss and damage coverage, and that they do not mention a deductible for warranty repairs or replacements.

The plaintiffs say that Beltone should have known that reasonable customers would consider the value of warranty coverage when choosing to purchase Beltone hearing aids, including whether the warranty coverage requires out of pocket payments.

The Beltone class action lawsuit alleges Beltone misrepresented its warranty coverage “with the intent to defraud consumers,” knowing consumers would be less likely to buy the hearing aids or pay the listed price for them if they were aware Beltone warranty coverage was subject to a deductible.

The plaintiffs assert claims for violation of the New Mexico Unfair Practices Act, breach of contract, breach of express and implied warranty, and unjust enrichment.

Miracle-Ear Inc. recently agreed to pay $8 million to settle a class action lawsuit alleging it sent automated calls to market its hearing aid products in violation of the Telephone Consumer Protection Act (TCPA).

    I just got this as well I didn’t know of any deductible I thought it was free he’s like oh by the way u owe me 300 bucks for the deductible

    Beltone, Tulsa, enticed with $998 hearing aid, but did not offer. Instead they said my hearing loss needed top-of-the-line aids for $7477.
    They ignored 21 CFR 801.420 (c) 2 Warning to Dispensers. I had five of seven conditions, but was not informed I should see an ENT BEFORE sale of aids. In fact HIS said he didn’t trust ENTS or Audiologists. I have since suffered serious medical issues. The product was misrepresented as “You will have no problems with sweat.” The warranty was written in acronyms and meanings not disclosed. This a partial list of infractions. Although I complained from date of receipt 8/7/20 that the aids had static, shut off/on as in an electric circuit problem, volume went up/down as in low battery, voices were garbled, the aids roared. I soon had head and earaches and developed anxiety and high blood pressure. The HIS insisted for a full year that it was my fault; my sweat and wax was the cause. June, 2021`, HIS declared the aids were completely corrupted and began hinting I might have additional charges! I asked for a refund via phone to Corporate. I was ignored. I sent refund demands to Corporate and GN-Nord, Denmark. No answers. I asked Wells Fargo for a chargeback. Denied. I can’t find an attorney in Oklahoma who will help.

      Same problem here I have to send in about every 3 months.they charge between 25. To 375. Every time. Half the time they forget to send the whole hearing aide. They just lie lie lie.
