If a company advertises a product at a sale price, that product must actually be “on sale.” Attorneys are currently investigating an alleged YMI Jeans fake discount to find out if YMI Jeans’ sale price is actually the regular price.
In order for a company to advertise a sale, certain guidelines must be met. For example, California False Advertising Law states that an item needs to be sold at a price that is “the prevailing market price” within the 3 months leading up to the advertised “sale” price.
In essence, for a retailer to advertise that something is on sale, it truly must be. The item must be marked down in price from the price it was originally sold at.
Sometimes companies advertise a sale price, but the item is always at that price. The item is never sold at “retail” value. When a company does this, it violates California False Advertising Law.
This law also makes sure that companies don’t make “false or misleading statements of fact” about the “amounts of price reductions.”
Some critics have alleged that a denim retailer based in Los Angeles has violated California False Advertising Law by creating a YMI Jeans fake discount and thereby harming consumers.
Allegedly, YMI Jeans may have been advertising products at a discounted rate when in fact they weren’t ever offered at a non-discounted rate. This alleged YMI Jeans fake discount could violate California False Advertising Law.
When a retailer like YMI Jeans engages in such a practice, it misleads consumers into thinking they are getting a sales price when in fact they are not getting a sales price.
In 2013, the Ninth Circuit Court of Appeals ruled that retailers may not use a false “original” price or false “MSRP” price in order to lure customers to purchase their products.
The “original” price must be the prevailing price for the three months prior to the “sale” in order to not violate California False Advertising Law. The Court noted that many consumers will simply purchase an item because they believe it is on sale and the deal is too good to pass up.
Consumers, according to the Court, have been financially harmed if the “original” prices were false and they purchased items they would not have normally bought.
Because of this, attorneys have been investigating the alleged YMI Jeans fake discount. They are working on determining if customers have been falsely led to buy products from YMI Jeans because of a YMI Jeans fake discount.
If you believe you have purchased products from YMI Jeans at a rate that may have been misleading and you think you are a victim of the YMI Jeans fake discount, you may be entitled to legal compensation and may benefit from speaking with an experienced attorney.
