A plaintiff filed a lawsuit against Unum Life Insurance Company of America, in Indiana federal court, requesting the reinstatement of disability benefits.
The plaintiff is Carrie W., resident of Indiana, who was insured by the defendant under a disability income policy.
According to the reinstatement of disability benefits lawsuit, Unum had promised to pay disability benefits to the plaintiff so long as she becomes injured or if she is unable to work due to an illness or sickness, in accordance with its insurance policy.
According to the lawsuit, Carrie had worked at Pulaski Memorial Hospital as a Radiology Manager. However, she later became disabled in August 2014 because of “disabling effects and symptoms” of pain in her left shoulder.
The reinstatement of disability benefits lawsuit states of the plaintiff that she suffered “radiculopathy, severe pain and loss of motion in her left shoulder resulting in the inability to use her left arm …”
Among other things, the Unum lawsuit further states that she suffered from “carpal tunnel syndrome, complex regional pain syndrome, lack of concentration and diminished memory capacity due to chronic throbbing and burning pain in her left shoulder.”
Carrie explains that she had submitted a request for long term disability benefits. That request was approved on March 10, 2015 for long term disability benefits through March 22, 2017. But according to her complaint, Unum had terminated her benefits “without any reasonable basis for the termination.”
According to the reinstatement of disability benefits lawsuit, she is disabled and has provided necessary documentation which included medical records and physician reports that indicate and establish that she meets the requirements for the fulfillment of the policy.
The Unum lawsuit maintains that the physicians have advised of the plaintiff’s inability to work. Her physicians have stated that pertaining to the plaintiff’s condition she, “is unable to use her left arm due to very limited range of motion, cannot perform sedentary work and her disability is not going to improve over time.”
Another physician says that because of her condition, she is not able to functionally work “in full time sedentary condition.”
According to the Unum disability benefits lawsuit, Unum Life failed to reinstate her disability benefits. Carrie says they currently refuse to pay her the disability benefits, despite documentation and physician reports that indicate that she is unable to return to work.
Carrie alleges she suffers financial losses and emotional distress because of the current refusal to reinstatement the policy. According to her reinstatement of disability benefits lawsuit, Unum wrongfully terminated the plaintiff’s disability benefits. That termination has resulted in the “loss of substantial life insurance coverage,” she claims.
She is asking the court to “enter judgment against Unum in an amount that will compensate [the plaintiff] for any unpaid disability benefits …”
The Reinstatement of Disability Benefits Lawsuit is Case No. 4:17-cv-00059-RL-JEM, in the U.S. District Court for the Northern District of Indiana, Lafayette Division.
