WhirlpoolA federal class action lawsuit claims Whirlpool and Sears sold defective KitchenAid and Kenmore-brand dishwashers with electronic control boards that can overheat and spontaneously burst into flames.
According to the class action lawsuit, Whirlpool and Sears market their KitchenAid and Kenmore dishwashers as “top-of-the-line” appliances that are of “superior quality, reliability and longevity.” However, Whirlpool and Sears concealed from the public that the electronic control boards in the dishwashers contain a dangerous defect that cause them to spontaneously overheat and cause the dishwasher to emit smoke and fumes and erupt in flames.
The KitchenAid and Kenmore defective dishwasher class action lawsuit also charges Whirlpool with failing to provide a satisfactory warranty that would cure or rectify the alleged defect, which the lawsuit alleges the company knew about since at least 2008.
The Whirlpool/Sears defective dishwasher class action lawsuit is brought on behalf of all U.S. consumers who purchased or acquired a KitchenAid or Kenmore dishwasher and its electronic control board overheated, smoked and/or caught on fire, and/or the dishwasher experienced a malfunction requiring replacement of the electronic control board.
It is asking the court to make Whirlpool and Sears pay for the repair and/or replacement of the defective dishwashers and/or defective parts and to establish a reimbursement program to honor warranty claims previously denied. It is also seeking restitution and damages for the proposed class.

The case is Steve Chambers, et al. v. Whirlpool Corporation, Sears Holdings Corp. and Sears, Roebuck & Co., Inc., U.S. District Court, Central District of California.

UPDATE: On Sept. 11, 2015, the parties filed a joint motion seeking preliminary approval of a Whirlpool/Sears defective dishwasher class action settlement.

    While we haven’t had a fire, these Kenmore dishwasher control panels are defective. At this point, half of the button faces have simply fallen off our unit. Very poor quality.

    Our expensive, high end kitchen-aid dishwasher broke under warranty several times due to over heating issues fuse etc were replaced, and would last for approx 30 days then blow.
    We can no longer use the dishwasher as Sears warranty was not fixing the problem, they have miss diagnosed the problem as the machine has an electrical issue that is causing components to get hot, heat up and blow. A fire could start.

    We had extended warranty and they will not do anything else. We paid $1200.00 for this high end product that did not last!

    We had a fire w/ are Kitchen Aid dishwasher on 14 Oct 2013. I never new about this problem, they put my family in danger. They sent out a repair man today (10/21/2013) he said it was the control panel all melted and it would cost me $500.00 to fix, and Kitchen aid wont pay.There moto should be “We take the money and run and if you burn your on your own”.

    I am willing to spend every waking moment informing the public of this disaster waiting to happen in their lives.
    What’s the point of healthy screenings , or Vaccinating our children or any preventative care in our lives if we are installing fire hazards in our homes. Which should be where we feel safe.
    Clearly we are a calculated risk, death or injury is not a concern to the company. I have read a link where they have given praise for only paying out 250k to seven home fires . I am appalled and angry.
    This is worse than a super storm or hurricane or vast fires roaming ten states , because there is no warning. My cabinets were charred before the fire alarm detected the smoke. I was standing there when it happened, thank God.
    I feel violated, I am injured , when will tis stop? Is this company above or rights to be safe in our own homes?

    I do not want a replacement kenmore GE whirlpool or kitchen aid dishwasher replacement , I’ve read over a hundred posts of house fires due to control board fire.

    I was violated,this is no different than being violated by another person in a dark alley.

    This issue needs to be addressed and remedied for our entire population. It seems Canada is taking this more seriously.

    Look on you tube at all of the reports this is a daily occurrence in the news .
    The value of the company is put far above the consumer safety.
    please post your efforts and outcomes. I am not allowing this to happen again to me. Enough. Every time the news stations contacts the company , same answer we can not comment on ongoing litigation.
    Enough speak up !

    Fire started in control panel I injured my arm , discharged 3 abc extinguishers into and around the appliance Lungs sore from extinguisher powder . Kenmore knew about this fire hazard , had routine maintence never told it was a fire hazard design with buttons on top where counter meets door. Apparently water from counter can short control panel wand I’ve read where it just startes fire while on timer or in any mode. Cabinets charred this was a 1500.00 dishwasher and had we gone to bed we would have died in a house fire

    I have a KitchenAid Superba Cinvection Wall Oven which has failed during the safe cleaning cycle due to overheating. Once the element blew and once the Thermal Protection fuse blew. There is also evidence of overheating on some resistors on the electronic control board .
    Totally unacceptable and seems to be prevalent problem that KitchenAid should address.

    My in laws had a kenmore dish washer and it caught on fire on 5/31/12. He was outside and heard the smoke detector. H went in and the kitchen was on fire with heavy smoke. He was over come by smoke and went to the hospital. He had lung surgery less than a year ago. Whole house has smoke damage.

    I had my Kenmore Elite catch fire on April 27, 2012. I was luckily standing right next to it and had to turn off the circuit breaker to make it stop. It was definitely the control panel that was on fire. Normally, I leave the house or go to bed after starting it up, so I was very lucky. Sears, however, is not too helpful yet. I thought a replacement dishwasher would be reasonable (and much easier than replacing an entire kitchen or house) for Sears. But, instead they offered me a 10% discount off a new dishwasher. Really? I too will continue on..

    David,
    Good luck with that! I just had my Kenmore Elite catch fire on 14 April 12. Been fighting a loosing battle with Sears and Whirlpool. Neither will take action and both deny knowledge of the faulty circuit board. Go figure! However, I will not back down…

    Based on the evidence I’ve seen, we need an acceptable Cause and Corrective Action Plan from Whirpool to isolate the circuit board problem to specific model and serial number units! Whirlpool must recall/repair or replace all potentially dangerous units, before houses burn down and any life is lost. If that happens they will be sued till they go out of business!!
