Wells Fargo

A settlement has been reached in a class action lawsuit accusing Wells Fargo NA of violating the Telephone Consumer Protection Act (TCPA). If you received an autodialed call or prerecorded voice message from Wells Fargo that attempted to collect on a consumer credit card account, you may be eligible for benefits from the class action settlement.

The TCPA class action lawsuit alleged that Wells Fargo placed calls to cell phones in violation of the federal Telephone Consumer Protection Act. The plaintiff alleged she received calls from Wells Fargo that were intended for the collection of another person’s credit card account. Further, these calls allegedly featured a prerecorded voice message or were made with an autodialer, in violation of the TCPA. According to the class action lawsuit, the plaintiff did not have a credit card account with Wells Fargo and never gave her express consent to receive the calls.

Wells Fargo denies the allegations but has agreed to pay nearly $14 million to settle the TCPA class action lawsuit to avoid the expense and uncertainty of continued litigation. More than 4 million consumers may be eligible for benefits from the Wells Fargo class action settlement.

Who’s Eligible

Class Members of the Wells Fargo TCPA class action settlement include cell phone users or subscribers to wireless/cellular service within the United States who received a call from Wells Fargo with automated dialing or prerecorded voice technology in an effort to collect on a consumer credit card account between Nov. 1, 2009 and Sept. 17, 2014.

Potential Award

Each eligible Class Member who submits a valid and timely claim will receive a pro rata payment from the class action settlement fund. The actual amount each claimant receives will depend on the total number of approved claims.

UPDATE: A viewer has reported to us that the settlement website is updated with the following: “The Judge granted final approval on January 29th. Once the 30 day appeal period passes, the Claims Administrator will begin processing the settlement checks.     I put in my number and it said it wasn’t valid, but I received a lot of calls from Wells Fargo Card services on my cell during the time period. I also received a card in the mail regarding this.

    So if everyone responds us consumers only get $2 each.. And the lawyer gets a few million… Wow. Why does he get a few million, he wasn’t the one harassed? I mean at least sue for enough money to put some gas in the car. A two dollar check, seriously? That literally doesent cover the gas after having went to go cash it, plus most places charge $3-7 just to cash a check. I would have to return to wellsfargo just to cash this check and im sure they would keep the money for some kind of bullshit fee. 2 dollars….? Jesus… I hope we at least get fifty bucks or something worthwhile. And people remember the less amount of people that file claims, means the more money we all get.. So it might be a better idea to keep this under wraps and not help other people file claims or encourage them if you want any shot at getting a few extra bucks. Thank god i paid off my credit card debt or i wouldnt even be able to cash this two dollar check…. I feel more insulted than i do ‘represented’ to be honest.

    So the lawsuit allows for 6 million dollars for the courts and lawyers, meanwhile each of us stands to receive roughly $2 a piece. If 2 million of us neglect to respond, that leaves a whopping $4 for each of us who do. Strict guidelines have been set up to outline consumer rights, Wells Fargo violates said rights and lawyers makes millions while disenfranchised consumers are spotted enough to buy a pack of Jolly Ranchers?

      Exactly,..promise you it won’t be over 2 bucks. Most of the money goes to attys.

    I went into the bank on 2 occasions and ask for help and was denied. At the last visit the girl clerk and a rep. on the phone made remarks that I had all my banking at the bank and then after a remark I could not hear on the reps end , they started laughting as if I was a good mark for their antics, what ever they were. I recieved many phone calls and even one to my job that angered me. I do want to get in on the law suit. Is this enough to get me on the list? I did receive a post card. Thank you.

      Well the settlement is for 14 million with around 6 million going to court and lawyer fees which leaves 8 million free between 4 million consumers

    I was sent two of these cards and cant seem to find neither of them now and have a new cell phone number. Could I be sent another card for the claim #.

      You can enter your phone number on the online claim form in place of the number on the card.

    I have submitted the form for the claim on the other page, I recieved a few phone calls reguarding my credit card acct But my brother also has a credit card through Wells Fargo that he got for college this last year and has received an automated ph. calls. He is not in the bracket of yrs you have on the card I recieved, so we did not enter him.

    I was unsure if I even qualify for this. I recived a post card in the mail for this case and remember recieving quite a few calls from wells fargo call centers to collect on a credit card debt from 2012-2013. If that has anything to do with this please let me know.

      Yes, you should qualify. Call the number on the card and give them the claim number as it is listed on the card.
