Walmart shooting lawsuit overview: 

  • Who: Walmart shooting survivor Donya Prioleau filed a lawsuit against Walmart Inc. 
  • Why: Prioleau claims Walmart knew about the male gunman’s “disturbing and threatening behavior” but failed to take action, making the company liable for his actions. 
  • Where: The lawsuit was filed in Virginia’s Chesapeake Circuit Court. 

A Walmart employee who survived a shooting at one of the store’s locations in Chesapeake, Virginia last month has filed a lawsuit against her employer, claiming she previously complained to Walmart about the shooter. 

Plaintiff Donya Prioleau argues she complained to Walmart about the gunman’s “bizarre and threatening behavior” two months before the Nov. 22 shooting that killed six and injured four of the company’s employees, reports Law360. 

Prioleau reportedly said she was in the Walmart break room when another employee came in and began shooting at her co-workers with a semi-automatic firearm, before she was ultimately able to escape to safety. 

The gunman had previously exhibited disturbing and troubling behavior, according to the lawsuit, with Prioleau claiming he had asked her at one point if she liked guns and told other employees he would “retaliate” if he were ever to be fired, reports Law360.

Prioleau reportedly argues the shooter — who was a store supervisor — was known for being “mean and cruel” and that Walmart had known about his “long-standing pattern of disturbing and threatening behavior.” 

Prioleau claims she is suffering from post-traumatic stress disorder that includes both physical and emotional distress as a result of the shooting, and says she had to receive medical care for shoulder and knee injuries sustained while escaping the break room, reports Law360. 

Walmart is reportedly accused of negligent hiring and retention, as well as liability for the actions of the shooter. Prioleau is asking for at least $50 million in compensatory damages. 

In October, Walmart agreed to a class action settlement to resolve claims it underpaid its workers by allegedly failing to incorporate bonuses into their sick pay.
