A woman has filed a lawsuit against Unum, alleging her Unum long term disability claim was unfairly denied.
The plaintiff, Sandra W., is an employee of Vanderbilt University. As an employee of Vanderbilt, she was covered under a group disability policy issued by Unum Life Insurance Company of America.
Sandra says she became disabled in November 2014—a disability that persists today. Her disability is included in the terms of her plan’s policy, she alleges, and she is therefore owed long term disability benefits.
After making her Unum long term disability claim, she says she was initially granted benefits for a period of two years. But in December 2016, Unum unexpectedly cancelled her benefits. She claims this reversal came despite the fact that Sandra’s disability had not improved, and she was no more able to return to work then than she had been for years previously.
Sandra tried to appeal this sudden reversal to her Unum long term disability claim, but she was again denied in July 2017. Sandra still considered this denial of benefits unfair, but she had exhausted all administrative approaches to resolving the issue. So, like many others who find themselves in a similar situation, she chose to file a lawsuit.
Sandra’s Unum long term disability claim may have been denied, but her lawsuit claims that this denial was born more out of a conflict of interest than anything else. After all, Unum funds the plan and calls the shots on whether or not any given Unum long term disability claim will be granted. Sandra’s lawsuit alleges that the company’s decision to deny her Unum long term disability claim was, in no uncertain terms, “arbitrary, capricious, unreasonable, irrational, wrongful, contrary to the terms of the Plan, contrary to the evidence and contrary to law.
The Unum long term disability claim lawsuit was filed on Sept. 15, 2017.
What Can I Do After a Unum Long Term Disability Claim Denial?
Even after being denied your Unum long term disability claim, you still have options moving forward.
A growing number of plaintiffs like Sandra are filing disability benefits lawsuits against Unum, claiming that the insurance giant unfairly denied their Unum long term disability claim to benefits that they qualify for under the terms of their insurance policies, often provided by employers.
This Unum lawsuit and others like it allege that Unum, as the largest disability insurance company in the country, has unfairly denied the disability insurance claims of plaintiffs who are, in fact, qualified to receive such benefits. Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other than to increase company profit.
