A woman from Indiana filed an Unum disability benefits lawsuit after the insurance company allegedly denied her benefits under bad faith insurance circumstances.
The Unum disability benefits lawsuit alleges the insurance company failed to perform its duty to the claimant, which was to give her claim a complete and fair review, but had allegedly opted to wrongfully deny her disability benefits.
Plaintiff Marjorie M. is filing her Unum disability benefits lawsuit, alleging she had met all eligibility requirements and should have been approved for long term disability benefits.
The Unum disability benefits lawsuit points out that Majorie had been previously approved for short term benefits, but was cut off from long term benefits prematurely after Marjorie informed the company her condition was more severe than initially thought.
According to the Unum disability benefits lawsuit, Marjorie had to cease working on Sept. 16, 2016 and applied for short term benefits for her treatment. Unum had approved Marjorie for this coverage, sending her last short term disability benefits payment on Jan. 25, 2017.
After her short term disability benefits expired, Marjorie had applied for long term coverage and had been initially approved. Marjorie says she was approved for long term coverage and began receiving payments in February 2017.
However, Unum reportedly told Marjorie that these benefits would stop after July 27, 2017, which goes against what her plan entitles her to. According to the Unum disability benefits lawsuit, Marjorie appealed this decision and pointed out that she was still suffering from multiple impairments.
Marjorie’s appeal was reportedly denied, and she continues to incur massive medical bills for her treatment.
Overview of Unum Claim Denial Problems
At all times relevant, Marjorie says, she had been previously fully employed and was eligible for both long term and short term coverage from Unum. To be eligible for Unum’s long term benefits, the policyholder must be completely unable to work and will not be able to get work in a similar industry due to their impairments.
In addition, the policyholder must show that they lost a significant portion of their income due to their inability to work and that the coverage will help with impending medical bills. Marjorie had met these eligibility requirements, and had followed all instructions when filing claims for both short term and long term disability benefits.
During the filing process, Marjorie says she submitted medical testimony from her physician that proved the severity of her medical condition. When Marjorie’s long term benefits were canceled, she alleges she submitted additional medical evidence when filing an appeal.
Unum denied the appeal and allegedly failed to adequately explain their decision. At this point in time, Marjorie says she has exhausted all administrative options and has been forced to file this Unum disability benefits lawsuit.
Unum Life Insurance Company is the oldest and largest provider of disability coverage in the United States, serving millions of policyholders. However, the company has recently gained a reputation for bad faith insurance for allegedly denying numerous disability claims under wrongful circumstances. Marjorie was one of these alleged cases, and she is seeking damages for all missing benefits payments and any other relevant damages in her Unum disability benefits lawsuit.
This Unum Disability Benefits Lawsuit is Case No. 1:18-cv-01100-TWP-DLP, in the U.S. District Court of Southern Indiana, Indianapolis Division.
