A Texas man recently filed a lawsuit over his Unum denied disability claim, alleging the insurance company denied him wrongly and unfairly.
According to the lawsuit, the plaintiff became totally disabled and unable to work, filing a claim for disability benefits through his employment. But after receiving an Unum denied disability claim, he decided to pursue litigation.
The plaintiff, Michael L., was employed as a mechanic, and was covered under a group disability benefits policy effective Sept. 1, 2007. In October 2011, however, Michael notes that he became disabled due to aseptic necrosis of the femur.
Because of this ongoing condition, Michael became unable to work due to disability and filed for short term disability benefits. These were granted. Later, when Michael filed for long term disability benefits, these too were initially granted. However, Michael received an Unum denied disability claim on July 22, 2016, reversing its initial decision to grant him these benefits.
Michael says this reversal comes despite the fact that his disabling conditions had not improved, and he was therefore no more able to return to work then than he had been for years previously. Despite this, Michael’s disability claim and subsequent benefits were terminated.
Receiving the Unum denied disability claim was not the end of Michael’s options. He immediately filed an appeal, but that appeal, too, was denied. After he had exhausted all administrative forms of combatting this decision, Michael decided to turn to litigation.
Michael filed his lawsuit over the unfair Unum denied disability claim on Oct. 6, 2017 in the U.S. District Court for the Northern District of Texas. The lawsuit was filed on multiple counts, including breach of contract, violation of Texas Insurance Code, breach of covenant of good faith and fair dealing, fraud, and prompt payment of claim.
Filing a Lawsuit Over Your Unum Denied Disability Claim
A growing number of plaintiffs like Michael are turning to litigation after receiving an Unum denied disability claim, alleging that the insurance giant unfairly denied their claim to benefits that they qualify for under the terms of their insurance policies and provided by employers.
This Unum lawsuit and others like it allege that Unum, as the largest disability insurance company in the country, has unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits. Some lawsuits go even further, alleging that the company has wrongfully issued a Unum denied disability claim to of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit. Indeed, former employees of Unum have reported being instructed to purposely deny insurance to people with legitimate claims to disability benefits in order to fulfill the company’s quota.
Consumers who have exhausted all recourse through applications and appeals for disability benefits may turn to filing a lawsuit over denied disability benefits, hoping to reverse their Unum denied disability claim.
If you or someone you know has received an Unum denied disability claim despite apparently qualifying for these benefits, you may be able to file an Unum disability claim lawsuit.
The Unum Denied Disability Claim Lawsuit is Case No. 4:17-cv-00803-O-BP, in the U.S. District Court for Forth Worth Division of the Northern District of Texas.
