Unauthorized recording of conversations is considered a serious violation California privacy laws, because recording requires the consent of all parties. This especially applies to businesses operating in the state of California, which are prohibited from conducting unauthorized recording of conversations of their customers and customer service representatives.
This applies to inbound and outbound calls the business may receive or send, with the customers needing notification that their conversations may be recorded.
At this point in time, several companies have paid large multi-million dollar settlements for allegedly conducting unauthorized recording of conversations in California. An ongoing investigation is looking into whether other companies, such as Baja Fresh, may have recorded phone conversations with customers and could be subject to legal repercussions.
Baja Fresh is a popular Mexican food restaurant advertising fresh food for customers, which uses designated customer service lines like most companies. It is important to note that recording customer service conversations is a common practice for employee training purposes, but it is vital for customers to give their consent before the call is recorded.
Overview of California Call Recording Policies
Even though many customer service calls are conducted on a daily basis, each of these calls must inform the customer their phone call could be recorded. This notification is often given at the beginning of the call, and then instructions are given to stay on the line or push a button on the dialing pad to indicate consent.
Even if the consumer does not have to press a button, staying on the line is still considered implied consent under California privacy laws. Unauthorized recording of conversations is almost always illegal in the state of California, with the state emphasizing the importance of consent.
Under the California Invasion of Privacy Act, Penal Code Section 632, all parties of two or more must give permission before their conversation is recorded whether or not it is over the phone. This law applies to any “confidential communication”, which applies to any conversation which would require consent of one of the party members to be shared.
However, it is important to note that not all unauthorized recordings of conversations are expressly illegal in California. This applies to conversations that do not qualify as “confidential”, which means that it may be reasonable to assume the information in the conversation to be overheard or recorded.
For example, included conversations are those made in a public area or in any “legislative, judicial, executive, or administrative proceeding open to the public.” Even with this exception, this would not apply to companies like Baja Fresh placing customer service calls to consumers.
Despite how easy it is to comply with the law, companies like Baja Fresh may still be conducting alleged unauthorized recording of conversations on the company’s toll-free customer service line. These companies could face penalties up to $5,000 per unauthorized recorded call if they are found to be liable for any of these violations.
Customers who allegedly experienced the unauthorized recording of conversations by Baja Fresh or other California businesses may be able to file legal action. Potential claimants should contact a lawyer to determine eligibility for a California call recording lawsuit.
