A Pennsylvania couple has filed a tractor trailer truck accident lawsuit against a trucking company and driver citing driver negligence.
Plaintiff Granville G. and his wife, Brenda G., both of Walnutport, Penn., have filed this personal injury lawsuit against Douglas Brown, who was driving a truck operated by Western Express, Inc.
Granville, according to this tractor trailer truck accident lawsuit, claims he was in his 2011 Ford Ranger and was transporting an ill coworker to a local hospital. He says he was traveling south on Schoenersville Road in the right hand lane.
A large tractor trailer, driven by Brown, was also traveling south on the same road, but in the left lane a little bit ahead of Granville. However, the truck made a right turn from the left lane directly in front of Granville, claims the tractor trailer truck accident lawsuit.
The driver’s truck, operated by Western Express, was a 2014 Freightliner Cascadia tractor trailer.
When Brown made this turn from the left lane in front of Granville, Granville’s car was so close that he was forced to veer right in order to avoid hitting the tractor trailer. However, when Granville swerved to avoid a tractor trailer truck accident, he struck a ditch and as a result, suffered injuries.
Alarmingly, the tractor trailer truck accident lawsuit states that the driver who made this turn mistakenly believed he was actually in the right lane of the road.
Granville’s lawsuit states that the driver of the tractor trailer was so fatigued while driving that he was unable to function properly. He was “incapable of safely operating a motor vehicle,” according to this tractor trailer truck accident claim.
The driver, Granville believes, should have known he was too fatigued to properly operate his vehicle. Because the driver “consciously disregarded his knowledge and continued to operate his vehicle anyway,” he posed a hazard to himself and other people on the road.
Granville alleges that as a result of this tractor trailer truck accident, he has suffered injuries throughout his entire body, including his bones, joints, tendons, muscles, soft tissue, and blood vessels. He also claims that he received injuries to his lumbar spine.
