Consumers who purchased a Straight Talk, Net10, Simple Mobile or Telcel America wireless service plan that was advertised as including “unlimited data” but had their data throttled may be receiving checks in the mail within the next few months from a class action settlement.
According to a post on the TracFone settlement website, the class action settlement will become effective on Aug. 1, 2015 and checks will be mailed by Oct. 20, 2015.
TracFone Wireless was hit with a class action lawsuit back in 2013, which alleged it advertised its prepaid “Straight Talk” cell phone plans as having unlimited data without informing customers that their data access would be limited and subject to “throttling” or termination. According to the TracFone class action lawsuit, customers who complained about the data cap were told only that they had “misused” their data plans but were not provide with further explanation.
The Federal Trade Commission also filed a lawsuit against TracFone for allegedly misleading customers about its unlimited data plans since 2009. In January, TracFone agreed to settle the FTC lawsuit and provide refunds to consumers. An estimated 8 million TracFone users may qualify for benefits under the terms of the settlement.
The $40 million TracFone Straight Talk class action settlement received final approval from a California federal judge on July 2, over objections from a Class Member who thought the deal unfairly burdened potential claimants by requiring them to contact TracFone to find out if they had been affected by the alleged data throttling.
The plaintiffs urged the judge to approve the settlement despite the objections. According to their motion in support of the TracFone class action settlement, Class Members who filed claims are expected to receive between $16 and $65, depending on how their cell phone service was affected by the alleged throttling.
The deadline to file a claim for the TracFone unlimited data settlement passed on June 19, 2015.

Well, its now 2023 and all 3 phones in our house are staright talk 55 unlimited plans and twice they have said our data was used up the day after we applied new minutrs. We called, and the markeyer that barely speaks clear english insists that the data we just installed was from the prior months plan( which we just added a day earlier then due date), then asks for the activation code number of the refill card, put us on hold for 20, minutes ,then comes back on and says its and old card even when when sent the walmart reciept as proof to him. We have had to get new phones twice now for all of us, because the phones after we went ahead and added more minutes (twice)would not ring, recieve messages/emails, or even signal! This law suit neefs to be brought back again- WHO IS MONITORING STRAIGHT TALK TO BE SURE THEY ARENT JUST VERBALLY COMPLYING?!

I see this was done in 2013 its now 2018 and my sons phone witch has the 55 unlimited data plan was just cut off for using too much data when i bought the card it said UNLIMITED data but when i called them cause his phone was cut off they said unlimited only up to 60gb how is that unlimited can u please help me
Every two months in 2019 they mess my phone up. Heck I’ll have just refiled 55 unlimited had full bars lte 4g and for 2 week would not connect when I called several time they say check it ok it works hang up and nothing. Also they turn data off when it says 2g after the unlimited runs out . well 2g is not no connection .

they changed my passwords , my bank account , with several forwarding mails and text messages that cames from a tracfone server
my emails and my bank account appears with a Correlation Stamp-date from other countries
I need to get help from
customer service and they said that my account is encrypted without my permission
I was with straight talk gave poor customer service internet conection sucked i was so nice about it for so long complained nothing never done so upgraded plan went back down cause it didnt really matter service sucked either way noticed i was average 3gb of data a month so up graded one more time and with in a week of time i used up all of 8 gb of data when i only used 3gb for months on in and one week i used up 8gb perhaps if watching movies that might be possible but i didnt watch any so after so long of putting up with their crap and screwed up customer service i switched to go to metro pcs but now straight talk wont release my number which has been my number and carried with me but its just not a number its something God was doing in my life when i got it 5374 which is my dads birthday and mine and now i may loose that number because of these selfish ass pricks and what upsets me is i dont have a dime to my name i have not seen my mom for so long and cant talk to her on my birthday now so no one can contact me on my phone and have not a dime to my name and i want to give and continue to give continue bless people to incourage them that their is a light still instore for them that their best days and bless days are still ahead to give them the shirt off my back because i want to because it is so much better to give then to receive God is so good but wbat they do at straight talk is so wrong on so many levels its not funny and they should be banned from cell phone. Ive had straight talk since 2012 and haven’t received any checks!!! Plus today, i haven’t had service or anything!! Called and found out someone whos not on my account had my account had my account deleted!!! Wtf!!
I’ve just gotten my second check. I recently switched because we have had so many issues AGAIN with straight talk. The data is a scam still to this day.
I have just received my second check from this settlement. I am ashamed to be involved in this type of thing. Straighttalk has provided me with great wireless service for years at a significantly lower cost than any carrier I am aware of. Further, they constantly improve my plan with more high-speed data, at the same cost. I haven’t decided if I am going to rip this check up, our cash it and spend the money on a higher tier plan, this month, but either way I feel like a thief who has received a cut of illicit loot.

Not only have I not received any kind of notice, and the first time I ever even heard about this lawsuit was from a friend who has another wireless carrier. I called to change/ update my credit card information with this carrier and these idiots changed my phone number a phone number I’ve have for 10 years that I use for work ! Who does that and gets away with it apparently this wireless carrier cause this lawsuit is bogus also apparently. No one will ever see a nickel of this so called settlement!

Same here. I kept my claim number all this time, filed back on June 19, 2015. I see from this thread and the FTC’s website that all checks were mailed in March of this year (2016), so I guess even though we have fallen within the guidelines of the class action suit, we just don’t get a refund. Not sure why. No great loss, though, as it seems the most anyone received was a measly $65.
