Spirit_AirlinesSpirit Airlines Inc. has been hit with another class action lawsuit accusing it of falsely advertising the prices of its tickets then nickel-and-diming customers for necessary services.

Plaintiff Nikki Giavasis alleges Spirit Airlines deceptively represents that its airfares are the lowest available on the market.

According to the Spirit Airlines class action lawsuit, the airline fails to disclose that consumers will be charged higher prices for baggage services and snacks than competing airlines charge, “thereby making any apparent savings illusory.”

Consumers purchase Spirit Airlines tickets through third-party retailers such as Orbitz.com, where the tickets are advertised as being the lowest airfare on the market, the Spirit Airlines class action lawsuit says.

“Nowhere in Defendant’s advertisements are consumers notified that they will be charged excessively for services that are related and necessary to airline travel,” Giavasis alleges in the Spirit Airlines class action lawsuit.

Giavasis says that costs of service such as baggage fees, seat selection and ticket printing are important to consumers when they make a decision about which airline to choose. She claims that Spirit Airlines advertises its air transportation as costing less than its competitors when in some cases, the fees for important services cause the consumer to pay more for travel than they would have if they had purchased airfare from a competitor.

Spirit Airlines reportedly does not disclose the costs of services until after a customer purchases tickets and conceals the fact that the price of the tickets do not include services that are often included as part of its competitors’ ticket prices.

Giavasis says that she purchased Spirit Airlines tickets in December 2016 through Orbitz.com, believing that she would save money by choosing Spirit Airlines over its competitors. When she attempted to check in online for her flight, she was informed that she had the “option” to pay to check bags, print tickets and select seats.

According to the Spirit Airlines class action lawsuit, the costs of paying for these services “annihilated” any savings she obtained by choosing Spirit Airlines over competing airlines. Giavasis says she felt “ripped off” and “cheated” by Spirit Airlines’s allegedly deceptive ticket pricing model.

“Defendant’s sale of ‘optional’ Attendant Services, which are in fact required and made available for no cost by competing airlines, were made available only after Plaintiff purchased tickets,” which, according to the Spirit Airlines class action lawsuit, “shows that Defendant knew that Plaintiff, as well as similarly situated consumers, did not know the true cost of airfare.”

The Spirit Airlines class action lawsuit was filed on behalf of Giavasis and a proposed Class of California citizens who purchased Spirit Airlines tickets in California and whose tickets were advertised as being the cheapest available.

Giavasis accuses Spirit Airlines of violating the California False Advertising Act and the California Unfair Business Practices Act.

Spirit Airlines was recently hit with a similar deceptive airfare pricing class action lawsuit in New York federal court.

    My very first experience flying with Spirit this year 2017 was a disaster. Since I had heard of the scam with the carryon luggage. I asked the reservationist prior to going to the gate for departure whether my carryon was ok. Only after getting the approval that I would not have a problem did I go to the departure gate. Only to be told just prior to departure that I would have to pay $65 for my carryon. Mind you, my regular midsize luggage was only $30. I was furious! Upon the completion of my trip. I contacted Spirit about what had happened with the nasty attitude of their staff, the surprise of the extra charge and to request a refund of the false carryon charge. They only credited $10 back to my account. This made me even more mad. The nerve of this company lying about the cost of a flight and then hiking the cost just prior to boarding the flight. They have some big nerve. I AM VERY INTERESTED IN JOINING THIS CAUSE. By the way, when I tried to contact them again to request the rest of my money. They did not respond.

    They had me on a layover in Houston and cancelled my next flight because of “weather conditions”. It was bullshit and said the next flight they could give me was 4 days later. Every other flight from other airlines was flying. And because of weather conditions they didn’t have to accommodate a hotel.

    They lost my sons carry on bag that they made him check. Deny checking the bag but my receipt says I did. 9 weeks later and emails after emails and I can’t getbteimbursed for what I had to replace while in the trip!!!!

    I woould like to join. I think advertising $9SFC prices that don’t exist once you join is very deceptive.

    Yes flew form OAK to LAV Sep 1 2018 trip was delayed mid trip to FLL flight to leave 1045 pm LAV to FLLfor 14 hours till 230 next day. No reason given. Looked like not alot of passangers weather was good. Hope this company goes out of business. Their employees will find work with who ever buys thier assts.

    I traveled spirit with my grandchildren and signed up for other class action they had wanted more info sent it in and never heard nothing called
    several times and they always said they would check into claim and call me back never heard anything

    I traveled on Spirit along with my husband and 6 other friends. We experienced the same thing. Luggage costs, having to choose seats and pay more because regular prices were not available. We could have traveled for less from Albany airport in NY and not having to travel 2 hours to Hartford, CT for the lesser cost.
