spirit-airlinesSpirit Airlines Inc. has been accused of using bait-and-switch tactics by promising consumers a low airfare but subsequently charging excessive fees for other services that make up the difference in the purported discount.

“Spirit falsely misled the Plaintiff and numerous other consumers, and continues to mislead consumers, into believing they are purchasing low airfare, when, in fact, Spirit makes up whatever discount it purports to give consumers in fraudulent and unwarranted charges,” the Spirit Airlines class action lawsuit states.

Plaintiff Thomas Cox points to the fee associated with bringing carry-on luggage, which he says costs as much as four times the cost of checking a bag in some instances.

“Spirit’s bait-and-switch and ‘gotcha’ tactics are designed to confuse, trick, and trap consumers to the public’s detriment,” the Spirit Airlines class action lawsuit alleges.

Cox asserts that these so-called bait-and-switch tactics violate the Consumer Protection Act of New York, and constitute fraud and breach of contract.

Spirit Airlines advertises itself as “an ultra low-cost, low-fare airline that offers affordable travel to price-conscious customers,” according to the Spirit Airlines class action lawsuit. However, the low-cost fares advertised by Spirit Airlines do not reflect the true cost of flying with the company, Cox alleges.

Cox says Spirit Airlines fails to make its fee structure clear to consumers at the time they purchase their airline tickets, especially when they purchase their tickets through third-party vendors.

According to the Spirit Airlines class action lawsuit, “consumers are often unaware of Spirit’s large and plentiful fees until after they purchase a ticket that initially appeared attractive.”

Cox alleges he purchased a round-trip ticket from New York to Florida with Spirit Airlines in September 2016. He said he purchased the ticket through Expedia after finding the ticket price to be attractive. He was unaware at the time he purchased the ticket that he would also be required to pay additional fees for a seat, baggage and other fees, according to the Spirit Airlines class action lawsuit.

He says he would not have purchased the ticket if he knew the actual cost would be much higher than the cost initially represented by Spirit Airlines. Instead of completing the round-trip travel with Spirit Airlines, Cox allegedly elected to fly back to New York with a different airline.

Cox claims Spirit intentionally hides its fees from consumers during the booking process to fraudulently induce sales. The airline does not inform consumers that they will be charged fees for services other airlines typically don’t charge, such as a fee for making changes to a reservation via telephone.

Other unexpected fees Spirit customers may face allegedly include customer service fees, passenger usage fees, checked and carry-on baggage fees, seat fees, and other fees that are either higher than expected or are not typically charged by other airlines.

“Spirit engages in a pattern and practice of withholding certain material information regarding the total pricing of a flight until consumers have expended resources and are irreversibly committed to taking the flight,” Cox says in the Spirit Airlines class action lawsuit.

Cox seeks an order requiring Spirit Airlines to clearly and conspicuously inform consumers about the various fees it charges and the manner in which voucher credits may be applied. He also seeks reimbursement for all ticket costs, fees, lost wages, and other expenses allegedly incurred due to Spirit Airline’s fraudulent conduct.

UPDATE: On Oct. 26, 2018, Spirit Airlines seeks dismissal of a bag fee fraud class action lawsuit, arguing that federal law preempts what the consumers are alleging that the “surprise” bag fee catches many flight passengers off guard.

UPDATE 2: On Nov. 20, 2018, Spirit Airlines customers are fighting to keep their class action lawsuit over unfair carry-on bag fees alive by filing an appeal a few minutes after a New York federal judge granted Spirit’s dismissal motion.

    I bought a ticket on spirit airlines. The initial price was quite attractive, but then when I chose NOT to add on any extras (I always skip choosing my own seat, avoid carry on’s, etc.) start entering my payment info, the website says, “the price of your ticket has increased.” The increase was about $50-60. Why? That’s a classic bait and switch. They bait me with one price, and then switch to a higher one without me even adding on anything.

    My flight was scheduled to leave at 10:30 out or gate 12. After they put up the new time they told us to go to gate 14. Concerned about the connecting flight. I got in line to ask a question. After the lady in front of me left I approached an quietly waiting about 20 minutes. The lady behind me said they haven’t even acknowledged you. I figured they would say one moment or can I help you. When the one lady finally said in a rude ton as if I was bothering them can I help you. I asked about the connecting flight and she sent me back to gate 12. At gate 12 I asked for the manager. I can remember her name. I have MS and it affects my memory. Manager said I’ll speak with them. That didn’t happen at least not while I was there. Now I’m in Ft Lauderdale. Before I get off the plane I asked the flight attendant who should I talk to in regards to my flight. The people at the desk who then send me around the corner who then sends me a little further who sends me to a line. Get next in line an associate come back and tell the lady working with me to take care of his people. But she finished me only to tell me my flight doesn’t leave until 10 pm. So now I’m crying because I am going to be here alone for 12 hours. I would have lost my job. I had to rent a car and drive to Orlando. So I won’t make tonight’s flight.

    Spirit has more than fee issues spirit has more than A lot of different issues it’s been this way for years but I think as the pandemic came it got worse My complaint and my problem is my daughter 20 years old and my grandson 5 years old took a spirit flight it was supposed to be at 3 o’clock uh they canceled and said that it was gonna be delayed until 6 45 6 45 came they said the plane was gonna be delayed until 9 45 9 45 9 45 Cain and they said the plane was gonna be delayed till 11 45 11 45 Kane and they said the plane was gonna be delayed till 1245 The airport closed at 10 o’clock the only people were there was spirit spirit does not have good customer service There was no one to talk to they put them out of the airport at 1 o’clock in the morning winning in Baltimore 1 of the worst cities in the US with no transportation with no hotel stays just put them out of the airport because they were closed and they didn’t have any pilots to fly their spirit planes this has been happening a lit’s been happening a lot you know you don’t have no pilots to fly your plane what are the pilots working on 1099 They’re self employed because if that’s the case then this might be understandable but the airport should not allow spirit to continue to fly and there can not They cannot honor their roots that is not fair to people who are paying to fly it’s a safety hazard to put people out at 1 o’clock in the morning and in cities they have no clue about you didn’t even give him a ride to a hotel Something needs to be done about spirit spirit needs to shut their whole terminal down

    Is there a way to join in on the Spirit class action lawsuit over the shadiness of extra baggage fees? I have been dealing with them for 8 months now and unfortunately Discover card came back from my Dispute and said that I need to pay my fee to Spirit. I see all over the we that the same thing is happening with other passengers. I would like to get in on a class action against them, I am not sure how they are still in business.
