Spectrum recently removed a class action lawsuit to federal court which will handle allegations that the internet company promises internet speeds it cannot deliver.

Plaintiff Carla Jimenez filed the class action lawsuit against Charter Communications Inc. and Spectrum Management Holding Company LLC claiming that Spectrum internet speeds are advertised as higher than what is actually delivered.

Jimenez says she currently has an “Extreme” internet plan through Spectrum, which she pays for so that her and her family can achieve higher internet speeds.

However, the Spectrum internet class action alleges that Jimenez has never attained the high internet speeds she is paying a premium price for.

Despite advertisements that consumers can connect “6-8 devices at the same time” and achieve “the fastest internet speeds available,” Spectrum internet speeds fail to reach the high speeds advertised, the Spectrum class action lawsuit states.

“For years and continuing through the present day, Defendants have defrauded and misled Plaintiff and similarly situated consumers by promising to deliver residential Internet service at speeds that Defendants knew they could not reliably deliver and that consumers could rarely, if ever, achieve,” the Spectrum internet speeds class action alleges. “Defendants also falsely promised to provide Plaintiff and similarly situated consumers residential Internet services with ‘no contracts’.”

Jimenez argues that Spectrum internet speeds which are used in advertisements do not represent WiFi speeds, which are what most consumers are looking for, but instead represent the speed of wired connections of devices connected via ethernet.

The Spectrum internet speeds class action claims that the company wrongfully uses these speeds to advertise their WiFi speeds with the intent of misleading consumers.

“[Defendants Spectrum Management Holding Co. LLC and Charter Communications Inc.] know their advertisements and related statements are false and misleading, and they know they are omitting material information from their representations that would impact consumers’ evaluations and purchasing decisions,” Jimenez claims in her Spectrum internet class action. “Defendants know that no consumers will reliably achieve the speeds.”

Jiminez argues that “insufficient infrastructure, overcrowded bandwidth, and underperforming equipment” also contribute to slower Spectrum internet speeds.

The Spectrum internet speeds class action also claims that the company’s employees are trained to encourage consumers to buy higher speed internet packages, despite the knowledge that consumers cannot reliably reach the higher speeds.

Spectrum has noted that Jimenez’s class action is nearly identical to a similar case filed in a California federal court last year. The company argues that Jimenez should be considered a Class Member in the other suit.

The plaintiff seeks to represent a Class of California consumer who have purchased a residential Spectrum internet plan.

The Spectrum internet speeds class action seeks actual damages, punitive damages, restitution and disgorgement, court costs, and attorneys’ fees.

Jimenez is represented by Jamin S. Soderstrom of Soderstrom Law PC and Douglas L. Mahaffey of Mahaffey Law Group PC.

    Spectrum calls me up to 5 times a day to sell their stuff– I filed a complaint– opted out from phone calls and visits– nothing changed. They use other peoples names –while I am dealing with contractors etc.I answer.— 20 calls in 10 days– 7calls in 9 days etc. I don’t want their business— Last year they called my Dish TV folks and cancelled my TV–so I would buy theirs Salesmen have been to my house 6 times. I will not do business EVER with them!!!

      When we be late making our payments Spectrum slows the internet speed down and still charge the same price. For internet speeds we are not getting. I have been with this company for 2 or 3 years and are always having a problem with my speed. They try to tell me it’s because we have too many devices hookup at one time. The most that is hooked up to my internet is 5 devices and I’m paying for Ultra package.

    Worst company I miss BH Iam constantly needing to bring their faulty equipment to them to switch out. This is like every 3 mons or so. They have outages cause my service to be messed up after they say their outage is fine and they want to say things like are you sure you didn’t cause this……Really it was working fine this morning your company had an outage and supposedly it get fixed but my service now has no signal going on day 3 grrrrrrr
    We the people deserve a good service company not this!

    I’ve been arguing the same thing to spectrum. They have charged me 50.00 for the last 3 of 6 technicians that have come out. Knowing it was them. There low scums. Just to take peoples money knowing there lying. Add me ive been with them we only have 2 options where I live. It’s about time they get what’s coming. Thanks for doing sonething

    I have no service in the rear of my house, I have had techs come out a dozen times, it is never fixed. The rest of the house has very poor service, and goes out constantly everyday. I pay $100 every month for the worst service imaginable. They own the lines so I have no choice. They are stealing my money every month for the worst service.

      That’s exactly what I’m going thru with spectrum. I’m so tired of calling them with just false promises that they will fix the problem.

    Please add me. I pay for 200 speed and don’t receive it. Plus, my internet goes down all the time AND it doesn’t even cover my whole house. They don’t provide extenders like Uverse does.

      I have been paying for internet but not receiving it for 8+ months. They ignore my requests to be reimbursed.

    Worst service! Unreliable and they refuse to fix their problems. They send service technicians out to find out why speeds are not right and why service goes down and they cannot figure out the problem so we are stuck paying for services/speeds not received.
