Spectrum recently removed a class action lawsuit to federal court which will handle allegations that the internet company promises internet speeds it cannot deliver.

Plaintiff Carla Jimenez filed the class action lawsuit against Charter Communications Inc. and Spectrum Management Holding Company LLC claiming that Spectrum internet speeds are advertised as higher than what is actually delivered.

Jimenez says she currently has an “Extreme” internet plan through Spectrum, which she pays for so that her and her family can achieve higher internet speeds.

However, the Spectrum internet class action alleges that Jimenez has never attained the high internet speeds she is paying a premium price for.

Despite advertisements that consumers can connect “6-8 devices at the same time” and achieve “the fastest internet speeds available,” Spectrum internet speeds fail to reach the high speeds advertised, the Spectrum class action lawsuit states.

“For years and continuing through the present day, Defendants have defrauded and misled Plaintiff and similarly situated consumers by promising to deliver residential Internet service at speeds that Defendants knew they could not reliably deliver and that consumers could rarely, if ever, achieve,” the Spectrum internet speeds class action alleges. “Defendants also falsely promised to provide Plaintiff and similarly situated consumers residential Internet services with ‘no contracts’.”

Jimenez argues that Spectrum internet speeds which are used in advertisements do not represent WiFi speeds, which are what most consumers are looking for, but instead represent the speed of wired connections of devices connected via ethernet.

The Spectrum internet speeds class action claims that the company wrongfully uses these speeds to advertise their WiFi speeds with the intent of misleading consumers.

“[Defendants Spectrum Management Holding Co. LLC and Charter Communications Inc.] know their advertisements and related statements are false and misleading, and they know they are omitting material information from their representations that would impact consumers’ evaluations and purchasing decisions,” Jimenez claims in her Spectrum internet class action. “Defendants know that no consumers will reliably achieve the speeds.”

Jiminez argues that “insufficient infrastructure, overcrowded bandwidth, and underperforming equipment” also contribute to slower Spectrum internet speeds.

The Spectrum internet speeds class action also claims that the company’s employees are trained to encourage consumers to buy higher speed internet packages, despite the knowledge that consumers cannot reliably reach the higher speeds.

Spectrum has noted that Jimenez’s class action is nearly identical to a similar case filed in a California federal court last year. The company argues that Jimenez should be considered a Class Member in the other suit.

The plaintiff seeks to represent a Class of California consumer who have purchased a residential Spectrum internet plan.

The Spectrum internet speeds class action seeks actual damages, punitive damages, restitution and disgorgement, court costs, and attorneys’ fees.

Jimenez is represented by Jamin S. Soderstrom of Soderstrom Law PC and Douglas L. Mahaffey of Mahaffey Law Group PC.

    I am suppose to get 200Mbps and I do not get anything near that. They tell me it is my router. My router can get as much as 400Mbps since I am a woman they think I am stupid. They are all in this together.

    I pay for 100 Mbps and it’s no where near that. When I called and asked them about it they told me that it because there are a lot of people on at the same time . I have went on different times of the day, night and even real morning. My TV acting like it was on shock Treatment they had to replace my box then my line and they were suppose to replace the line in the back of my home they have yet to do it . add me to the list please

    Spectrum is the worst. They have no ethic, they lie to their customers and put them and their technicians in danger:
    My connection never reached its full potential, and this month has been the worst ever. While i upload documents, my husband see his connection stopped, when he watched a video, it’s my turn to have no internet connection at all… i called customer service, and they told me i was the only one complaining in my area… so their told me the problem came from the modem. They sent a technician.
    The technician came a week later (my husband an I are both teachers, and we need to teach our students remotely during the quarantine… internet is ESSENTIAL to us).
    When the technician arrived he showed me the email that had been sent 2 weeks prior to the customer care service to inform them of the saturated network in my area. Basically he told ma that I have been paying for years for a service that is technically impossible to get.
    He then changed the modem, as he was instructed to, but he was honest and told me it wasn’t going to change anything until the lines in my area are getting fixed/updated…..
    Bottom line: the technicians at Spectrum are being put in danger by going to people’s house unnecessarily + the customer care are LYING to their customer. And with the current situation, they don’t provide fee/bills relief or reduced price offers. This is unacceptable, and they need to pay to make up for all the troubles they provide to their customers.

    Please ADD ME to any class action against that terrible company!!!!

      Wow ! Same thing happening here ! Since last year around February I upgraded to the “fastest internet” speeds spectrum had , got fed up of the slow speeds so I said fine I’ll upgrade and the only thing we received was “SLOWER INTERNET SPEEDS” I mean ridiculous from supposedly 300 Mega bits and speeds where about 40 to 60 meg bits !! We called numerous times they claimed my modem (a net gear c7000) was the problem , didn’t understand if it was only a year old at time and purchased for $150.00 which worked perfectly fine but they insisted … asides that a tech came out 3times on separate occasions but theyll just replace connectors on cable and replaced the cable etc.. just a show all it was … even tho they showed that the internet speeds had a boost for a day or two never will it be at top speed I doubt thats ever happened or have I ever witnessed the speeds at there highest rate “Never” it’s a myth!! Hopefully this lawsuit sends them a slap in the face and people will know now this company is a fraud and cancel all services for good!!! Smh!! Definitely Sign me up for this class action !!!

    I pay for 100Mbps and it’s no where near that. My internet sucks always buffering everyday. It has become so annoying not being able to watch the whole of anything. Frustrating. I would like to be apart of the class action suit against Spectrum/ Charter Cable companies.

    I live in Orlando, FL and I have the same issue. I have 100 Mbps plan, but I ony get 15 to 30. Everything is hardwired. I use the spectrum modem and the nighthawk 1750 AC Router. I had two technicians come out and third one tomorrow. To be able to stream seems like a dream.
