A California man recently filed a lawsuit against Unum after his sleep apnea long term disability claim was denied, alleging the claim was denied wrongly.
The plaintiff, Mustafa S., purchased a disability income insurance policy through Unum decades ago, back in 1993. He alleges he became disabled under the terms of the policy due to sleep apnea and narcolepsy. He says he was prevented from performing his duties as an emergency medicine physician and began experiencing cognitive difficulties and mood swings, having trouble completing tasks.
Though he sought treatment from a psychiatrist for these issues, Mustafa was ultimately unable to perform the “material and substantial duties of his position.”
Mustafa filed a sleep apnea long term disability claim, but his claim was denied. He alleges that he was actually entitled to his sleep apnea long term disability benefits under the policy, but that the insurance giant failed to pay him those benefits, breaching the terms of the policy.
Mustafa filed his sleep apnea long term disability lawsuit on Feb. 15 in the U.S. District Court for the Central District of California. The lawsuit was filed on multiple counts, including breach of contract, negligence, and declaratory relief.
Unum Benefits Claim Denial
Mustafa is far from the first policyholder to have been denied benefits through Unum policy. Some disabled consumers seek reinstatement of their disability benefits by pursuing the administrative means available to them, including appealing Unum’s decision. However, even when a consumer attempts to make an appeal, Unum may still deny this request. After exhausting administrative means of appealing this decision, some turn to litigation to seek the company’s reinstatement of disability benefits going forward.
A growing number of plaintiffs like Mustafa have begun filing disability benefits lawsuits against Unum. Lawsuits allege that the insurance giant unfairly denied their Unum benefits that the applicant qualified for under the terms of their insurance policies provided by their employer.
This Unum lawsuit and others like it allege that Unum has unfairly denied the disability insurance claims of plaintiffs who are entitled to receive such benefits. Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit.
Filing an Unum Long Term Disability Lawsuit
Consumers who have exhausted all recourse through applications and appeals for disability benefits may turn to filing a lawsuit over denied disability benefits, hoping to reverse Unum’s denial.
If you have been unfairly denied long term disability benefits by Unum, you may be able to seek reinstatement of disability benefits by filing an Unum lawsuit.
The Sleep Apnea Long Term Disability Lawsuit is Case No. 8:18-cv-00262, in the U.S. District Court for the Southern Division of the Central District of California.
