Skims wage lawsuit overview:

Kim Kardashian’s Skims shapewear and loungewear brand is facing a wage lawsuit accusing the retailer of stiffing hourly workers on overtime pay and required breaks, according to Law360. 

The lawsuit, brought as a Private Attorneys General Act (PAGA) representative action, was lodged in the Superior Court of the State of California, County of Los Angeles. PAGA allows an employee to sue on the state’s behalf for Labor Code violations affecting other workers.

The plaintiff claims Skims failed to pay hourly and nonexempt staff for all hours worked and regularly denied them full meal and rest periods required under California law. According to the wage lawsuit, missed breaks came in several forms — short, late, interrupted or skipped altogether.

The Skims lawsuit claims the wage abuse extended beyond broken breaks. The plaintiff claims Skims failed to reimburse employees for necessary business expenses despite having the financial means to do so, and instead used the savings to boost company profits.

On information and belief, the “defendants engaged in a uniform policy and systematic scheme of wage abuse against their hourly-paid or nonexempt employees,” the lawsuit states.

Skims wage statements allegedly omitted total hours worked

Beyond overtime and breaks, the wage lawsuit claims Skims failed to provide hourly employees with complete and accurate wage statements and payroll records. The plaintiff alleges the paperwork left out total hours worked each pay period, and that Skims withheld wages owed upon resignation or termination.

Law360 reports the lawsuit is one of several legal disputes involving Skims in recent months. 

In January, Skims Body agreed to pay $200,000 in civil penalties and continue issuing refunds to New Jersey shoppers after allegedly collecting sales tax on tax-exempt clothing for nearly five years, according to the New Jersey Attorney General’s Office.

A separate Skims class action alleging violations of the Americans with Disabilities Act over the company’s website was filed in Illinois federal court in 2025 and voluntarily dismissed that July.

Meanwhile, Banana Republic and Gap agreed to pay $1.95 million to resolve claims they violated California labor laws by failing to pay minimum wages, overtime wages and other wages.
