Nordstrom, PetSmart and Nike lawsuits overview:

Two new class action lawsuits and a class, collective and representative lawsuit allege Nordstrom, PetSmart and companies involved in a Nike commercial production denied hourly workers compliant meal periods and rest breaks and failed to pay all wages owed.
A Nordstrom employee filed a class action lawsuit against Nordstrom Inc. in Washington state court; four former employees filed a separate class action lawsuit against PetSmart LLC in Colorado state court; and a production assistant filed a related class, collective and representative lawsuit against Iconoclast Content, Nike USA and Wieden + Kennedy in California federal court.
The three lawsuits allege hourly, non-exempt workers were denied uninterrupted, duty-free meal periods and rest breaks in violation of respective state laws.
The Nike-related and PetSmart lawsuits make additional claims that plaintiffs performed unpaid work outside their scheduled shifts and were not paid all wages owed once their employment ended.
Plaintiffs in all three lawsuits are seeking unpaid wages, penalties or damages, interest, attorneys’ fees and other relief under applicable federal and state wage-and-hour laws.
Lawsuits detail unreimbursed tools, off-the-clock work claims
The Nordstrom lawsuit claims the company’s timekeeping and staffing practices routinely produced missed, late or shortened meal periods that went unpaid, alleging the “defendant’s failure to provide compliant meal periods and rest breaks is willful.”
The lawsuit proposes a class of all hourly, non-exempt Nordstrom employees in Washington who worked any time since July 21, 2023.
All four PetSmart plaintiffs allege they performed unpaid, off-the-clock work at the start and end of shifts due to overscheduling. Two of the four also claim they paid out of pocket for dog grooming tools and sharpening services without reimbursement, while a third alleges a manager said “figure it out” when concerns were raised about missed meal periods and rest breaks.
The PetSmart class action lawsuit proposes a class of all hourly-paid or non-exempt employees who worked for PetSmart in Colorado.
The Nike-related lawsuit alleges production crew performed uncompensated work before call times and after wrap, including checking in, gathering equipment and completing paperwork. It names Iconoclast as the plaintiff’s “controlling employer” while alleging Nike and its ad agency, Wieden + Kennedy, jointly controlled the production, and claims the plaintiff’s wages were paid weeks after the statutory deadline.
The lawsuit proposes a nationwide Fair Labor Standards Act collective of nonexempt production crew members paid by Iconoclast, as well as a California class of workers whose wage statements identify Iconoclast as the “controlling employer.”
Other companies currently facing allegations of unpaid wages include FedEx, Kroger, UPS and Home Depot.
