Banana Republic and Gap agreed to pay $1.95 million to resolve claims they violated California labor laws by failing to pay minimum wages, overtime wages and other wages.

The class action settlement benefits individuals who are or were employed by Banana Republic and Gap as non-exempt retail store employees in California between Oct. 27, 2022, and July 4, 2025.

Plaintiffs in the class action lawsuit accused Banana Republic and Gap of violating California labor laws by failing to pay minimum wages, overtime wages, meal period premiums, rest period premiums, sick pay and more. The retailers allegedly failed to provide accurate wage statements and other required documentation.

Banana Republic is a clothing retailer owned by Gap Inc., the parent company of Banana Republic, Old Navy and Athleta.

Banana Republic and Gap have not admitted any wrongdoing but agreed to a $1.95 million settlement to resolve the wage-and-hour class action lawsuit.

Under the terms of the Banana Republic settlement, class members can receive a cash payment based on the number of pay periods they worked during the class period. No payment estimates are available at this time, but class members will be individually notified at the time.

The deadline for exclusion and/or objection is July 21, 2026.

The final approval hearing for the Banana Republic settlement is scheduled for Nov. 9, 2026.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive settlement benefits. Class members who wish to dispute their pay period information must submit a challenge by July 21, 2026.

The class action settlement benefits current and former non-exempt retail store employees of Banana Republic LLC and The Gap Inc. who worked in California at any time between Oct. 27, 2022, and July 4, 2025.
