Sharp LCD TV Replacement Panel Small Claims Lawsuit

By Mike Holter

Sharp LCDA San Diego man has filed a small claims lawsuit against LCD manufacturer Sharp Electronics, claiming the company prevents people from replacing their damaged LCD screens at a reasonable cost because it charges “exorbitant costs” for replacement panels.

Plaintiff Tracy Turner alleges in the small claims lawsuit that when he tried to fix his damaged 70-inch LCD Sharp television, he was quoted a repair price that was almost double the cost of a new TV. When Turner asked why the replacement panel was so expensive, the repair center allegedly stated that only Sharp sets the price and that is what Sharp charges, the small claims lawsuit says.

Turner accuses Sharp of breaking several California laws, including price fixing, unfair enrichment, and violations of the Cartwright Act and California Consumer Warranty Act.

He says his $2,600 television’s value “was reduced to almost nothing because Sharp prevents, by deceptive business practices, people from replacing their damaged LCD screens at a reasonable cost. This is putting local companies like television repair services out of business, not to mention, costing everyone millions to replace televisions that could be easily repaired.”

By proving that Sharp was guilty of preventing the repair of millions of broken LCD television screens by rigging the price of the replacement parts, Sharp could be on the hook for millions of dollars in damages, according to a statement about the small claims lawsuit.

Turner is seeking treble damages, penalties and restitution.

UPDATE 5/9/2012 – This was incorrectly labeled as a class action lawsuit. It is a SMALL CLAIMS case, NOT a class action, though a class action lawsuit may be filed in the future by attorneys familiar with the case. If that happens, and we’re notified, we’ll post an update in our Lawsuit News section. We apologize for any confusion.

I have a 70 inch sharp. Less than 2 years old. One day I turned it on and there were lines that looks like the screen is cracked. I call the store where I bought it from. They sent not one but two technicians to come look at it. They told me I have a cracked panel due to physical damage. But the I am confused because there is no physical on my tv. The techs could not point it out to me. All they kept telling me was it was a crack panel and will need o replace the panel, which will cost more than the tv. Now I am unhappy about with the situation and would like to talk to someone else. Anybody who can help me please do so. Thanks.
